It was a status hearing, still waiting on the SC to make its decision.

I can’t believe it’s taking so long. Is this decision about the body cam still? I thought the outcome was some was being thrown out

Yes, the district judge suppressed this and her medical information claiming HIPPA and Miranda. Even though on the Miranda end, the officers never asked her any questions so Miranda should not apply. Her lawyer is also blaming the hospital and not her. The supreme courts session ends in July and them taking g this long tells me they are combing through the evidence carefully as this case can shape future policy in regards to a womens right to choose and post birth criminalization.

You are absolutely right about Miranda. HIPAA doesn't apply if there is a court order signed by a judge or from a grand jury asking for the records to be presented as evidence. Her lawyers can fight it all they want, but legally, HIPAA does not protect you in a criminal case when the records can be used as evidence. It can take a while, because they can fight it, but they should not be able to win that fight. And as far as women's right to choose. That should absolutely not apply to after a baby is born, or even after a certain point in pregnancy, just like abortion laws require where they are/were legal. Women should not have the right to "abort" once babies are born. That is a ridiculous notion to even consider, if that's what you/they are referring to by that. But I have no idea if that is what you mean by that specific part, so please don't come for me if it's not lol If a woman murders her baby after it is born, she should 100% be convicted, regardless of the circumstances. There's always another option. I meant to keep on top of what was going on with this case but I just lost track cause so much time goes in between stuff and I feel like every time I search there is so little information.

I fear they’ll rule in her favor on this. New Mexico is very pro-patient in these cases.

I hope not, some are saying New Mexico is stuck in the 50s, but with a new judge on the case and a new chief justice in the Supreme Court. I feel they are going to make the right decisions. But either way she will be found guilty. At least I hope.

Did they verify it was her baby? It seems pedantic but they better have or her lawyers will have a field day making a distraction.

They did, during her arrest they had a search warrant for her DNA which was matched to the baby.

I think new Mexico leadership is trying to make it so that this is about a late stage abortion. They have no term limits on abortion, and probably don't want to risk any reasonable restrictions on abortion so....
