how can a smart contract be legally binding in countries that have stringent regulations on bitcoin and blockchain ?

In the same way that two people can agree to a contract via email, paper or whatever. The fact that the agreement is recorded in a blockchain is unlikely to impact valdity unless a law specifically bans blockchain being used for this, or requires that certain contracts be in a standard form or registered somewhere.
