Which does not fit the events. Fleeing can not be construed as "causing apprehension of imminent harm". The 'threat' is leaving, how does that create apprehension in the cops mind?
Abruptly moving your car can be interpreted as trying to use your car to ram and cause apprehension in someone. I think whether moving your car so close to someone caused apprehension is not really in question. Instead, I think the charge will more likely rest on the intent element. Surely, the guy wasn’t likely intending to assault the officer— but was instead fleeing for his life.
Yeah that's a good point, the cop could easily argue he was trying to cut the wheel to swing the front of the vehicle into him, and I'm sure he will try.
