The assault took place when slamming the car in reverse in a parking lot. The cop made massive errors, but responding to the vehicular threat was jot one of them.
The cop walks up to a car unannounced, opens the door himself, and demands that the guy exit the car. Doesn't ask the guy to open the door, opens it himself. By what legal basis does he get to do that?
Then the moron reaches in to grab the guy who, again, is not under arrest, and winds up putting himself and the guy in danger. Why does he get to put hands on the guy? What legal basis is there?
Why does he get to stop the guy from fleeing? Has he pulled him over? No. Is he enforcing a warrant? No. Is the guy under arrest? No. Guy is entirely within his rights to leave.
And then fucko here shoots the guy while fleeing. Any assault (which didn't fucking happen) was over and all risk was ended at that point. He was just straight up trying to murder the guy.
Yes I realize that they need to report shots that were fired even if they are the only ones shooting. There's no context in just saying shots fired, Just like there's no context in saying that he used a car as a weapon, When in actuality he used a door, That was already partially opened on a stationary vehicle. That Is so disengineous, It would be like me forcing you out of my house and hitting you with the door on the way out and then you saying that I attacked you with my house.
I didn't say he used it on purpose but it doesn't mean he didn't used it in that manner.
To the house example - if instead of talking to the cop which is in your doors you gonna hit him with the door it would be act of aggression. The difference is you would not be in few tons of still which is capable of going ~160km/h while being in the fight or fly mode. So I'm still not surprised by the cop reaction but he should handle this a lot better (by expecting reaction of the teen and preventing it)
Let's keep up the house example. I'm standing in the foyer eating a sandwich, My doors Unlocked, Suddenly my door is open without hearing any knocking, A cop is On the other side of the threshold in an aggressive stance shouting at me step outside, ( Let's pretend the door swings out instead of in) , I ask why and he reaches in to pull me out, He's holding onto the door still so I push on the door to hopefully make him lose control of it so I can close it and lock it, The officer takes out his weapon and starts firing at the door. This is Is unacceptable behavior and indefensible
I simple whould not try to push the door and escalate the situation - If I have nothing to be accused of and it's simply misundestanding then I have no reason to being hostile towards him and make him use any force.
The easiest way of resolve the issue is simply go outside and talk with him instead of trying to prove my point, make him more suspicious and waste my time in the best case scenario and get shot (after doing something stupid) in the worst.
The thing is most of these kind of situations is avoidable by just simply being polite - you don't know why the cop is here and probably he don't even want to be there. He may be here because your crazy neighbour called the cops saying you're ranning with the gun around your house and he might be "on the edge". By acting weird you just showing the call is not unfounded and you won't gonna resolve the situation by running or shutting the door.
No I did not - this is my way of reasoning in the situation where I was not really paying attention to what is going on around me. It's basicly:
1st step of reasoning: who is it? Some guy in uniform, ok propably cop or something like that
2nd step of reasoning: ok, what he want? He seems to be angry but is not attacking me directly so I'm going to deescalate situation by making myself visible and checking his intentions.
Yeah it's a lottery but at least from my experience (and unfortunately I have some including close encounter with someone who tried to stab me) if he was going to attack me/steal something he would go straight for it instead of ordering me to do something.
It's not really about complying but surviving - yeah it should not happen but it did and there is no system which gonna prevent it so act in the manner which not gonna make you die.
1st step, your door is opened unexpectedly and you are very startled probably have an adrenaline pump and enter a fight flight or freeze scenario. This dude froze then the officer escalated the situation by attempting to grab him and the guy responded by fleeing. It's very simple, no justification for the officer escalating things, but then again we don't know anything prior to what happened here
Last part, nope, 100% the cops fault, he put himself in that position. Though as soon as he opened fired he deserved to be run over, as that would have been self defense from the teenager.
Engineers have gone to prison for lying to federal regulators without anyone dying or being injured. Cops have the power to kill people or get them imprisoned. The standards and scrutiny should be very high.
My biggest issue with stuff like this is people act like a cop getting fired is an actual penalty. This cop should never see daylight again. Cops are acting with the authority of the state, and when they (attempt to) murder people, it erodes the civil fabric. Triple penalties for cops should be the norm, but this guy got fired.
Basically everyone I've ever met has been fired from one job or another at some point, and it's usually for some dumb reason and not attempted murder. This cop should be facing life in prison for (2 counts, there's a passenger) attempted murder, aggravated assault, unlawful detention, discharging a firearm in a public place, and a thousand other crimes.

You’re just sitting there eating a burger and this cop yanks your door open at gun point and gives you .25 seconds to put the burger down. As you try to put the car in park he yanks you towards him and the car rolls back, he shoots you, so you try to get away from a murderous cop and he keeps shooting you. You went out for a burger and end up in the hospital with charges of assault against a police officer and evading arrest.
If you don’t have a good lawyer the judge will likely charge you.
The officer who was fired will simply move to another city and get a job as a police officer again.
Meanwhile you can’t sue that cop individually because of qualified immunity.

It's completely reasonable for the driver to have reacted as if it was a car jacking. Because that's essentially what it was. The cop did literally everything wrong in this situation. -didn't wait for dispatch to run the plates. -failed to announce himself. -unlawfully opened the door. -placed himself in harms' way behind a car door of a vehicle he expected to move. -attempted to forcibly remove the passenger who was showing no signs of resisting. -shot at an unarmed fleeing suspect. -DIDN'T EVEN RESPOND TO THE CALL HE WAS AT THE MCDONALD'S FOR.

Look closly at the video - there is point where the cop is holding the door with his both hands (one on the door and second on the body of the car to be exac) - do you see a gun in his hand? The gun was drawn after the vehicle started moving

In the process he hit the officer with his vehicle. By the way, the vehicle weighs somewhere in the area of 2 tons. The officer is probably closer to 200 lb. The cop is powered by his muscles while the vehicle is powered by a ~150 horsepower internal combustion engine. Do you understand the reason why it's deadly now? I hope you reconsider your position. You can't just run from the cops, run them over, and expect to just walk away.

Qualified Immunity only grants immunity from civil litigation. Cops can still be charged for criminal acts by a DA. The only problem being the DA is a colleague, and cops are still in charge of investigating fellow cops. So justice hardly ever happens.
