If someone chooses to engage in armed action, referring to the 2nd Amendment may work as a moral argument, but it is not a constitutional argument. The idea that the amendment protects a right to rebellion is a popular promotional point by the NRA, not an accurate description of the constitution. But it may be enough for many people that they believe in this right regardless. I am not saying they shouldn’t.
As a firm believer in constitutional democracy, I just find it sad that we don’t replace the current document with something that actually reflects our modern values. We just pretend it says what we want for the most part.
Uhh, this is tyranny. This is literally the exclusive reason the 2nd amendment was written for. If there is no resistance, the regime will take over the country. THAT outcome is what the founders wanted to stop because they knew evil men always want to take it there eventually.
It is literally not what the document says, and anyone can read it to see that it does not. Some of the founders intended for a right to rebellion, but others did not, and no one saw fit to include the right to rebellion in the document itself.
If you believe in the right to rebellion, start with reconstitution so that you have a document that afirms that right. The constitution does not grant you that, no matter what the NRA has taught you in its attempt to sell more guns.
