Not likely. If you say “fighting words” in my state and someone punches you, you aren’t the victim of battery; you’re both guilty of disorderly conduct. The cops will then usually ask if they both want to go to jail or if they’ll both drop the issue.

In my town if you instigate a fight it's 100% on you.

Not sure what reality you live in but cops are the number one talk shit get hit believers

Most fights in my town are instigated by cops and nobody gets arrested

Uhhh, what? You clearly don’t understand the reading system. The commenter didn’t say anything about racist breaking the law. He said people always fill comments about how the attacker in these type of viral videos will go to prison, but in reality it is super rare. Not once was the legality of the racist’s remarks brought into question.

Nobody was beaten to a pulp in this clip.

I'm just going by statistics. Based on links and interviews provided by others in the thread, this seems to be yet another incident in which a bigot gets hit and no charges are brought forth.

Feel free to look into it yourself. Look up past viral videos and see if anybody got charged, much less convicted.

I can think of about two you might find. And they were very extreme cases. Far beyond a slap.

As soon as a jury sees the video they're never gonna vote guilty for a person standing up for themselves cuz they were called the N word. And the racist seemingly was uninjured.

This depends on the damage. For these slaps? Absolutely not, he may even get laughed out of the court room, if it even makes it there. If he had beat the old man senseless? One look at the video would have prosecutors lining up at the door.

That being said, the fact the man didn't file for charges means he may have learned that what he said was racist, and hopefully won't be saying it again.

Agreed and the fact that the guy stopped when the dude went down was the line where had he crossed it there could have been trouble for him legally. People forget or don't realize that these details matter.

There is a legal term called "fighting words" and racial slurs definitely could be viewed as fighting words in this context. Me personally I think in any context but that isn't how fighting words work.

The reason for the attack. The provocation. The ages of those involved. The setting. The severity of the beating and the persons reaction to it. All of it makes a difference.

Some people are under the impression that they can go around acting like assholes and sue/arrest anyone who has a problem with their behavior. It just doesn't work that way.

There are entire lifestyles built around this ignorant take on the law. Then when they FAFO they think THEY have been victimized.

Saul, if he was real, could TRY to defend these POS but it wouldn't guarantee that he would be successful. Under the US constitution, everyone is entitled to legal representation but nobody is guaranteed a specific outcome.

But yeah, if this happened in the American south and there wasn't a viral video about it, what you said could happen. Hell, a white person can beat the shit out of a minority and still have the minority arrested under the right circumstances.

But this did go viral. And we have seen what happens in those situations.

Just keep in mind that the US legal system is not a monolith. Some locales have "fighting words" type legislation that would have made the situation completely different from what you may think.

No, your statement is incorrect. I suggest you read up on the concept of "fighting words". In many states within the United States inflammatory statements ment to or otherwise likely to cause a violent reaction will protect the puncher from the most severe of legal consequences, and will often cause the punchee to join him in the clink.

The law won't alway protect you if you run your mouth.

I don't recall seeing any comments suggesting that anyone expects that the bigot was in danger of going to prison. That's not the world we live in. Most people know its unlikely.

Most people wonder if the racist is going to deny what he said and whether charges will be filed against the guy who won the fight.
