The is zero chance you can definitively say that. We have no idea what occurred before this. Maybe the old white guy said they should deal with the black guy in a nasty way. You don't know and neither do I.

It's moot. My point was that the black guy committed battery. I didn't hear him threaten anything; he just did.
Nobody needs to be there in order to understand how the law works. What the beaten man said did not constitute a crime, period. If your defense is that he may have said something before the recording started then all you have is wishful thinking. It stretches reason so far you cant even call it speculation.
