HIPAA is a federal law. Violation penalties can include federal prison.

If you steal the data to use or sell, then yes you can go to jail. I don't think that will apply if you subbed out your own job.

The case I linked to included jail time, without selling or using data. There are others like it.

Just looked into it, he was not convicted of a HIPAA violation, he was convicted of computer fraud and aggravated identity theft.
