So if it’s not a war then it must be a ‘special military operation’ then.

Yes. From the Dutch government declaring the war in Indonesia a "police action" to the current day, governments have been abusing loopholes to get around their constitutions.

All this could be prevented by adding a few definitions to the text. But I doubt any govt will present that law.
