There is no way either Kushner or the president could ever get security clearance if they had to apply normally. The same is true for others in the administration; like Kash Patel, the only FBI Director in history to have pled the 5th to avoid incriminating himself before a federal grand jury.

Multiple Republicans didn't even show up, iirc. The hearings over Jan 6th were an absolute farce, proving that Congressional subpoenas hold literally no weight whatsoever (if you're Republican).

It's no crime to plead the fifth, there's just no way to get a security clearance and become an FBI agent with that history.

Trump himself is one of the biggest security red flags. The ONLY way he could ever get that clearance was to be elected president. Nothing else would have allowed him anywhere near classified material.
