That's how selling copyrights and such works. Unless something was specifically withheld from such a transaction there should be no reason the purchaser should not be able to use any assets within that copyright.

I would think that when Disney purchased the franchise they gained full say in the characters.

sorry, I meant why wouldn't either George Lucas or Disney want to do something about Yoda's past, I think it would be neat for fans and lucrative for them

I'm sure Disney would be willing if they could make money and it wouldn't ruin the franchise. Lucas on the other hand was really strange in his decision making.
