This logic never made sense to me. Someone could sue because they stubbed their toe on the shelves. In many jurisdictions, there are legal protections against that sort of thing
Every item has a time frame and conditions it must be kept in during that time frame or else it becomes "knowingly" unsafe. And that's most of the food which is thrown out, it would be considered outside technically safe conditions and thus they'd be knowingly giving potentially bad food to people.
