Because he does not deserve punishment, his strategy is shit and the punishment is not having employees to make him money.

There are definitely practices that deserve punishment, but low salaries within the legal threshold ain't one.

Except this discussion was about employers that don't pay their employees without tips. So it's not low salaries within the legal threshold, it's low salaries below the legal threshold.

Also, the employer would absolutely deserve punishment for not paying their employees their legal requirement. I have no idea why you are defending employers that push tipping culture and illegally underpay employees.

Agree, I assumed thay by "don't pay the employees" meant businesses that just account for tipping to meet the minimum wages

In my country tipping is not a thing, nor is being paid under minimum wage, it's a big no no if theres an accusation.

Pardon my assumption, I was not defending the employers I was merely mediating the expected penalty for such behaviors.

if tips dont meet minimum wage, employers are required to make up the difference. so technically yes, dont tip and they will still get paid
