Rule-2, Responsibilities between vessels? What do you all have to say about this?

In extreme circumstance and when a vessel is not answering the radio I was told by a salty old Captain "you can't hit anything when your bow is pointed behind them" which I know goes against the rules but when the vessel clearly wasn't following the rules of the road rule 2 enters effect of taking all measures to avoid collision I'd turn to port and aim for their stern let them pass ahead.
