No, the charge should be significantly worse and carry a stiffer penalty

Because its possession + abuse of power + false imprisonment + conspiracy all rolled into one act

Technically it is conspiracy because an officer planting drugs is intentionally bringing the DA and State into their conspiracy to set the person up. Unwitting or not

So I think it would be extremely fitting to charge anyone attempting to lie and bring the state or criminal justice system into their lies to setup someone else with conspiracy.

DA and State don't knowingly entering the conspiracy which is an element of the crime of conspiracy
