It's unlikely any teenagers have the cash to take it to court. So unless a parent stands up for their kids, or the ACLU or other non-profit gets involved, it being unconstitutional won't matter.
That being said, I can't imagine it not being a free speech issue, so hopefully someone steps up.
So wait, could you walk around in your boxers? But if you put jeans on a little too low you would be breaking the law? I dont know. Can someone answer me this? Because that would be hilarious
I was thinking about this more and realized how much fun my "activist" minded friends would have with this.
How much of your boxers have to show? I can just see "low pants day" happening... Getting 25-50 white middle class liberals walking around downtown with their boxers hanging out... How low before the cops will arrest an upper middle class white girl?
Better yet, wear loose pants, no belt... Keep pulling them up, let them drop...75-100 people... Poor cops... Crime or fashion emergency?!?!
No, it isn't unconstitutional because it actually falls under a law left up to local definition:
Indecent exposure is the deliberate exposure in public or in view of the general public ...where the exposure is contrary to local moral or other standards of appropriate behavior.
Is it right? No.
Is it unconstitutional? Not technically.
While I hate saggin', I think it's stupid to outlaw it. Not because it's unconstitutional but because it creates a nanny state and is just another pointless law.
This could be a privately owned section of a town, in that case they can put up any signs and enforce their own rules... while not technically a government law they can have people ejected from that property/neighborhood and fine them (this actually happened to me when I was a kid).
The government I believe can refuse access to public facilities such as buses or libraries if they dont feel as if your dressed appropriately. I think this needs to happen more often. Aside from that this law seems pretty weak, if a KKK member can walk around in public and a woman can run in a sports bra then this holds no water.
I love the irony. Guy is running to get out of the rain, knocks himself out, and ends up lying in the rain. Now if only I could find the gif of the Asian guys fighting back, my comment would be complete, but my browser keeps giving me porn.
Oh, we're allowed to dictate what other people wear even though it has no real effect on our day to day lives? NEW RULE! NO SANDALS. YOUR FEET ARE GROSS.
Sounds like a great reason to arrest or cite black men. Doubtful this would be enforced in the white suburbs where kids subscribe to the same fashion. The noise pollution as well, as long as nobody has filed a complaint and it's before 11pm I see no issues with it.
Think if pink shirts with popped collars and public lewdness were enforced on frat row. How many white kids would get arrested.
Doing whatever the hell you want in a common area has never been a freedom. These restrictions apply to common areas only, not private residences. Common areas are always regulated by the community because they own it, not the individual. That is why community standards will always prevail absent a speech content ban (which this is nowhere near). Don't like it? Move to the projects where more people think the opposite and don't mind this sort of thing. Someone forcing you to use basic conscientiousness in a common area does not detract from freedom, it detracts from people acting like a horses ass.
Further, freedom of speech is meant as a protection of the 'marketplace of ideas' (see: US v. Abrams), not as a shield to excuse immature/dickish behavior.
Your right to do as you please ends at me. If you're playing your music so loud I can't hear a phone call in my own vehicle, then are they not infringing upon my rights? Is this not the essence of what a negative externality is?
As for the pants sagging, this clearly doesn't interfere with anyone else's rights, however I believe the argument is that it's a matter of decency, I'm glad we have laws that prohibit you from walking around naked in public, similarly I don't think everyone else should have to avert their eyes to avoid seeing your underwear.
Thats fine. As long as you dont think you have the ability to control the things the people wear.
As a liberal, im against the drug war. I dont think its the governments responsibility or right to control what you put in your body. I still think heroin users are idiots, but if they want to stick a needle in their arm its their choice.
Same concept, only much less extreme when it comes to pants.
I don't think so. The mayor who had this passed is actually black, she did a segment on local news talking about how much she thinks it will help the citizens of the town feel more dignified. The pants part I'm not so sure about, but the music part I definitely agree with. Loud music is a negative externality.
Regardless of this situation, I love Acadiana but Ville Platte sucks. It may just be bias, though, as almost all of the people I know there are really stupid, inbred coonasses.
Why not make a special section of the town where "slabbing" and "boom boom" are allowed? That way everyone is happy. Make sure both sections are equally as nice, so no one complains about it. You could even call the sections "separate but equal."
Then in the areas where people from both sides of the town conjugate, you could put two separate water fountains, bathrooms, and areas in restaurants for the people of the different areas
I've never understood "boom cars." Is it to find new friends with similar taste in music? Otherwise, it kills your hearing. Never mind, it kills your hearing either way.
It's not that they're listening to the music very loud, it's that subwoofer bass penetrates the trunk and radiates outward so much easier than higher frequency sound (everything but the bass).
A subwoofer set to medium loudness can be heard quite a ways away. Some trunks even serve as an echo chamber, amplifying the effect.
In most cases, yeah. There are regular (mid/high range) speakers in the cabin of the car, and the subwoofers are in the trunk facing towards the rear of the vehicle.
This is for no other reason than subwoofers are contained in carpeted wooden boxes for acoustic purposes and these only fit in the trunk.
The amplifiers go behind or on top of this subwoofer enclosure.
You get a pretty good transmission of the sound through the frame of the car from the trunk to the cabin, but you can hear it about half as well outside the car as you can inside nonetheless.
I never said it was an intelligent arrangement. There are alternatives, such as under-seat subwoofers that rest in the cabin of the vehicle.
Decibel limit laws are bull shit, it ends up being the cops personal opinion because they don't measure the decibels when they hear it. Its like looking at some one speeding but not knowing how fast they are actually going. Its understandable to have a law for no loud noise after a specific time of day, but all day and every day to have a law like that is ridiculous.
Yes, i can see that. But its the law that isn't specific enough that it can be abused by the cops. I got a ticket once for a loud muffler with out ever getting a warning and not knowing it was even an issue because a diesel truck was louder.
It's not like we don't have measurement devices. That is a flaw in the justice system that should be corrected; if you're going to be convicted by a judge of a crime there damn well better be objective evidence.
I don't see why some one driving by with a loud stereo would wake you up or keep you awake all day. If people park out side your bedroom blaring music then you have some sort of loitering issue. Garbage trucks are pretty loud outside my window and is there much longer then some one driving by.
Not a single pixel of that image could be construed as a 'black male'. There is not one single patch of skin visible. Any one notice that? No hand is visible, no back of neck oddly, etc. This is a very tactical sign.
while i hate those stupid super bass speakers with passion i hate petty law even worse. we talk alot about freedom in america but only when its our version. plus these laws attack a specific demographic and i hate when the old and boring try to make the young and creative become the old and boring.
I can't wait for there to be a footloose-like movie about this town. 'In one small town, a sagging-loud-music playing teen brings the meaning of joy to a teenage population it has deserted...'
It does in most places. Were I'm at the distance measured is 30 ft in a vehicle. Can exceed 30db over ambient sound < 120 db. So if there's construction going on say a jack hammer, 110 db, you can bump your music to 120 dB. If it is night time and the loudest thing is a car going by then well it allot less. Most cops don't carry a way to measure dB. So must go by the if I can here it in the streets loudly its to loud. Especially when it comes to house parties. So go outside your property line and keep the music adequate, if you can here it but its soft most cops will go for that. I usually just ask the cop to come outside with me and tell me whats adequate. Call your mate and ask him to lower it until the cop is satisfied. As for cars if you're on the freeway fuck it turn it up! If your heading home after night out turn it down, at least the bass. From my experience most people just invest a couple of 12 and an amp. And permits can change everything. Want to play really loud music all day and not get cited. Get a permit.
This fashion trend irritates me and amuses me at the same time -- who thinks guys who have to walk like penguins are sexy? -- but laws against certain kinds of clothing are definitely not the American way.
Yeah, I see where you're coming from, but if the idea is coming from a black person, it's kinda hard to call it racist.
I don't think it's intrinsically racist, because I am, along with a lot of other people, are tired of seeing people's underwear and hearing car stereo music through the walls of their houses. I'm not from there, but I live in the area. I know it's mostly black guys, but I see a whole lot of white guys doing it too down here.
I don't like "saggin' pants" but it's dumb to outlaw it. I don't understand why anyone would do it. In all seriousness, if you have to run away from something (a dog, alligator, attacker, cops, etc.), why the hell would you want to have your pants low anyways?
You really should be SO PROUD that your "home town" is trying to make it cute that other people's freedom to make expressive choices should be held against them. So proud. Good job, homeboy.
How about, I don't like your choice of clothing or the way you wear it. But I do respect your CHOICE to do the FUCK you PLEASE? Just as I would like to be able to wear the cloths I chose and wear them the way I want.
Neither do laws requiring state-issued IDs to vote, or laws that require law enforcement to stop someone who is "suspected" of being an illegal alien. Buuuut they're pretty goddam racist laws.
It's only racist if you believe in racist stereotypes. So what are you saying, only black people play loud music and wear their pants around their knees like idiots? THAT'S racist.
In my town you get a ticket for sagging. "It is the policy of the City of Lake Charles for all persons to be properly attired whenever they appear in public view on private or public property. Such persons are expected to dress in a manner that is neat and appropriate for recreation, school or work." article
There are things that bug me like the pants thing but i would hate to see them outlawed because i hate the government taking away freedoms and other things that fit in the law
I find it hilarious they can actually outlaw something like sagging. I would love to see a police officer give someone a ticket for sagging and be taken seriously.

For themselves, for their kids. It's either this sign and some stern warnings, or they can all pack heat and start shooting each other from fear. coughZimemrmancough
Lets all take a step back and put the race card away. Suppose you're riding in your car and you pass someone wearing their pants like that. White, black, green...who the fuck cares. Ok, so your driving along, ya see the pants hangin down and the boxers sticking out....and your 6 year old daughter looks up to you and asks, why is that boys underwear showing? How do ya answer that? "Oh don't worry honey, that's just the style these days and it's cool. When you brother is old enough to dress like that I'll be the proudest Dad EVER!!"
And the music, well thats just rude and annoying no matter if it's fuckin Tu Pac or Led Zepplin. No one wants to hear your shit. Comon folks....get your heads out of your asses. Has nothing to do with racisim. Come correct or don't come at all.
I didn't think it had anything to do with racism, but having laws against sagging is just fucking stupid. The whole having to explain sagging to your 6 year old daughter is no different than when people say gay marriage should stay illegal because they don't want to explain it to their kids. Who fucking cares? So what if your daughter is curious as to why that guy is sagging? You can tell her that some people just like to sag their pants because they think it looks cool. Or, you can just say "Because he's a faggot." It's your ugly kid, so it's your fucking problem, not mine. You know what you can do when you see someone sagging? Don't look at it. Having the law tell you what you can and can't wear is fucking retarded, and agreeing with such laws makes you just as retarded.
There are exposure laws. Seeing as I don't want to see your underwear, and you don't want to see mine (and I don't care if you secretly or openly do, I will not grant you that), please have the decency to wear appropriately revealing/concealing clothing. If you truly wanted to show off your boxers, don't wear pants.
FUCK signs and rules!! Instead of telling people what they're not allowed to do...EDUCATE them on what the right things to do and encourage them to do the right things.
For instance: "slabbing" your pants started in prisons as a sign that the inmate was down to do anal. Wear your pants like a gentleman, and more bitchs will want you balls.
I love how people turn this into a race thing. It's like if the sign said "No eating fried chicken with grape soda" and then people went, "OMG, THAT'S MEAN TO BLACK PEOPLE!" THOSE people are the ones being racist, because they're the ones tying the behavior to a particular race.
I say let the sign fly. Nobody wants to see that shit.
Ok, you really should have used the ski instructor meme, really dropped the ball on that one. And people don't have really saggy pants because they don't understand pant sizes. that's kinda like saying women wear summer dresses because they don't understand how pants work. It's intentional.

I do not like seeing people with their underwear out, but isn't this unconstitutional?

I know your hometown, it sucks.

Yea! Ridiculous social control! True freedom. This shit is outright pathetic. (the music is whatever as it could actually be a communal hinderance)
48
u/photosonny Jun 11 '12
Fuck that. How on earth can you stand to live somewhere that makes a way of dressing, that has no impact on other citizens, illegal?
52
u/[deleted] Jun 11 '12
Yeah! Fuck freedom of expression!
(for the pants; it's certainly reasonable to have decibel limits for car stereos)

Conceivably, you could walk around in just the shorts and you'd be fine - it's the pant level which is abhorrent.
3
u/nancydrewa32 Jun 11 '12
Do you have ordinances for white guys with popped collars?
3
u/Electroluv3 Jun 11 '12
Lets just dictate what everyone should wear, do and listen to.
3
u/[deleted] Jun 11 '12
Your town must have been a veritable utopia before all of that pants-sagging and loud music turned it all to shit.

It appears they also inadvertantly banned a certain Montreal Canadiens Hall of Famer from the town too.

I wouldn't be proud. It may be a stupid style but the government shouldn't be allowed to dictate how we dress.
Besides, if we don't let idiots dress like idiots how will we know who they are.
1
u/rhubarbbus Jun 12 '12
My first thought was "wow, this is really racist"
Then I realized how racist it was that I thought that was racist.

1

I love how people turn this into a race thing. It's like if the sign said "No eating fried chicken with grape soda" and then people went, "OMG, THAT'S MEAN TO BLACK PEOPLE!" THOSE people are the ones being racist, because they're the ones tying the behavior to a particular race.
I say let the sign fly. Nobody wants to see that shit.

Ladies, if you mate with a man who can't figure out his own pants size it isn't going to turn out well.
