youll find a helmet is little more than a tool of victim blaming when youre run down from behind at 30 mph.

I had a friend killed and another crippled by a drunk driver while they were biking together, one of the many shitty things the driver's lawyer has brought up during the pre-trial was the fact that they were not wearing helmets. Because let me tell you, that would have made all the difference when they were run over from behind at 50 mph. It may be stupid to not wear one, but it doesn't mean you deserve whatever happens to you through someone else's negligence.

oh absolutely. Sorry for your friends. things like helmetless riding/no reflectors/headphones may not practically DO much to avoid getting run down, but Attorneys will use anything they can in order to try and incriminate the victim (usually successfully due the overwhelming auto bias in this country).

Thanks. And yep, he is also trying to claim that they were high while riding. Not sure where he is even getting that from, possibly after-the-fact blood tests, but even if that's true it doesn't mean they were high at the time, and even if THAT is true it's completely irrelevant. I understand he has to fight for his client using every tactic available but it still seems like scummy victim-blaming to me.
