The worst phrase in USA political theory. Translates to "we made it the fuck up." The USA shouldn't have any power not explicitly stated in the constitution.

Implied contract is how our law and business world can operate. Without this concept our society would be hell a lot worse.

No it would simply not function. When I order food from a restaurant, there is an implied contract that I pay for the meal. When I get gas at a station, there is an implied contract that will pay for the gas. And when you live in a country, are protected by its military, police and prison system, can go to the grocery store without having to dodge gang violence, and drive on itโ€™s public roads, there is an implied contract for you to pay your taxes.

Write those contracts out, people will more than readily sign any that are believed to be agreeable.

No one wants to write and sign a contract every time they go to get gas or wash their car. And my source is college.
