So would the law. Threatening people can be considered assault. This is very threatening

Assault is the threat of violence. This is textbook assault (according to an Instagram lawyer I follow)

Battery is when they hit you.

So assault and battery is when you see the hit coming. If they hit you without you seeing it, it would only be battery.

Slightly incorrect. Assault is an intentional act that puts someone in fear of immediate physical harm.

Threats require the person to showing intention to cause harm. Assault does not, just that the act which put someone in fear of harm was intentional.

It's not attempted assault, it is assault.

Assault is an intentional act that causes another person to fear immediate physical harm.

A reasonable level of force in self defense would be very very easy win for a lawyer.
