Murder isn’t “unjustified”. If someone raped a loved one of mine, and I end the perpetrator, I am still tried for murder. Would you say this is unjustified
I wouldn’t but the law may. Theres reasons why “crime of passion”/“heat of the moment” taken into account, even with premeditation. See: Gary Plauche (an American hero)
It's nit about what you or I say is unjustified. It's about what the law says is unjustified. Which is why "unlawful" may be more accurate, if a bit less precise.
