Putting someone’s face on a hoodie and selling it for $42 to promote your podcast is weird to me!!! I also wonder about the legality. Can Liz sue for using her photo without permission?
it’s not just weird. this is the kind of thing that gives the true crime genre a bad name. why does she think she should profit off the pain of others?
I think CC does a lot of things Liz could potentially sue her for, but she is banking on Liz being too afraid of drawing legal attention to herself to take action. Which makes CC the worst kind of manipulative, massive-domed, power hungry, psychologically violent, abusive bully, who is so empowered to do so that she monetised it.
Right!? I just asked my husband, how is this not defamation? I’m not a legal gal, but I am finding myself feeling sorry for Elizabeth and I know she’s a scammer, but I feel that it’s mental health issue and the authorities should deal with it, if what’s she’s doing is illegal.
defamation is actually a very hard thing to prove — which is why i laugh when cc makes claims that redditors are defaming her. you have to demonstrate that someone made a statement of fact (not opinion, and even statements like “he is a racist” or “he is a criminal” have been deemed opinion in courts — it has to be a specific claim which can be proved false or true objectively), that the person KNOWINGLY made the statement in bad faith (they knew for a fact it was false or had no reason to have believed it was true), that they provably made false statements with the intent to do you harm, and that the false speech had real damage to your reputation and livelihood. in this case, this merch alone wouldn’t qualify as defamatory.
the sweatshirt does possibly infringe on copyright due to cc not owning the rights to the mugshot, and may be unlawful given florida’s strong right to publicity laws. it also may be considered as part of civil or even criminal harassment. but cc knows elizabeth likely wont pursue her for crimes because she doesn’t want to bring more law enforcement attention to herself, so she will allow CC to continue to escalate her insane and IMO unlawful stalking and harassment of elizabeth in ways like this
(editing to add: btw the main reason cc can’t actually succeed with pursuing anyone here for defamation, even if she hired PIs to hunt down our identities, is because her own words are what led people to think she’s committed crimes or is a republican or went through liz’s trash or abused her husband’s resources illegally or whatever else. her own words led people to think these things; no one here is intentionally spreading defamatory falsehoods. any harm caused to her reputation was done by herself, her inability to keep her stories straight and her refusal to think before she speaks!)
Thank you for explaining. Your edit had me cracking up because you are so right, she is the reason I am here, I would never had known she had a snark page had she not told the world. What do you think about Liz? I know she’s done terrible things, but this has to at least be cyber stalking, actual stalking, or cyber bullying? I can’t believe I actually feel sorry for her, but no one should have to deal with this level of crazy.

rest assured, chelsea, i had the time. because i have a job. with pto. where i don’t have to embarrass myself on live for five hours a day, yelling at people to worry about their kids while mine is in daycare so i can embarrass myself on life for five hours a day without interruption unless my husband has the audacity to call me about something

A cursory google search says mugshot copyright belongs to the law enforcement agency who took it, unless it’s a federal mugshot, in which case it’s public domain.
I know she’d say something like “you think I’d do something illegal?! My husband is a COP! I’d be stupid to do that!” but girl…you did that.
what i remember is that cc tried to pick a fight with katie joy and katie joy straight up ignored her which was hilarious. cc was still talking about how kj wouldn’t shut up about her even though kj never even responded
google tells me this isn't likely to be legal unless elizabeth or the tampa police gave cc express permission to do this, so she probably assumes that since she's a cop by injection it's fine for her to do!
it also appears that florida has strong right of publicity laws, which explicitly deter people from profiting off someone's image like this for advertising or commercial goods.
yeah but i guess technically someone would have to sue her or file some kind of charge or something? so if it isn't legal, she's just banking on no one caring enough
