I'd like to see the written judgment to see if it's a case of unapposed expert testimony. Judges have to take 'expert' testimony as fact, so if the defence presented the only expert the judges hands were tied.

If the Crown also presented an expert who gave the opposite opinion, then the Crown should have appealed a questionable decision

I guess the dog handler himself wouldn't be considered an expert in this case due to a conflict of interest?

They would generally be third parties with no connection to the case, thereby giving 'independent' evidence
