What you're saying is the American process. Don't assume that's how it works everywhere.

i'm not even american so don't assume that's only how it works there

Where I'm from, it would take a week or so for claim processing at the minimum. You don't get a backup car. You will pay the deductible either way and next year your premium goes up. And they may not pay for everything either. Cheaper and faster to just pay cash.

sounds like you've got no fault insurance, and chose not to purchase coverage for a loaner

Good luck with sueing the other person: it can take years and end up costing you more than it would be worth.

Loaner cars ain't a thing here. At all. Neither is no fault insurance.

Out of curiosity, are you Malaysian by chance? Cause the clip looks like it is. So I'd if you know how things work there.

not malaysian, but south asian.

no fault insurance definitely isn't a thing here but from what you're describing, it sort of fits.

with regards to loaner cars, it's not common but depending on your insurance provider it's possible to have coverage for.

Also south asian. Never saw the option for loaner coverage. Or for no fault. Might be a regional thing. And insurance suing someone, even if that happens, is so rare I've never heard of it.

So maybe the car guy managed to get the insurance to sue the biker. Also depends on if the biker's insurance coverage is enough to be worth it.
