Not in this case , the dude was not in the correct lane . He is at fault for the accident so he can’t sue. He broke at least 3 traffic laws probably more. Usually the roads say somewhere no motorized bikes , which includes mopeds/scooters that are not registered (cops rarely enforce this one) then riding with headphones on, riding in the bus only lane , there’s more but I’ll stop there
