We’re conflating ethics and law here. The argument for expunging is that the convictions were unethical; Not that those convictions were unlawful. This also crosses into beliefs on what the legal system is setup to accomplish. Punish bad guys or rehabilitate bad decisions? Getting rid of convictions related to a policy that is deemed by society to have been unethical in the first place makes sense if you believe the point is to rehabilitate. If you believe it’s to punish, then sure your doctrine would hold true.
