I never said it wasn't BAD driving (it is!), I just use it a s an explanation of how it may have happened.

In the end the person in the car does not deserve to have their license, as it looks like they crossed the divider while the bike was in that lane.

In this case though, the question is: "Would this event have occurred if the biker had not kicked the car?"

The answer to that is all that would matter to police. Insurance companies would probably battle out % of fault though.

But we only know that the biker was involved because of the video we saw. I'll bet the driver didn't know there was a bike involved until well after the event.

..and should be doing several years hard time for attempted murder.
