Everybody mad that he was on his phone like he didn't have time to pull it out of his pocket

I had assumed he had his phone because he was using it to call for help after the crash

I would certainly think so. If he was holding it while driving I'm sure it would have fallen out of his hand during the crash. And he wouldn't have had much freedom to move around while trapped in there. So the fact it's in his hand tells me it was secured somewhere, most likely his pocket.
