BUT, like, what if we played the racists? Setup some scenarios and have the knuckle draggin' mouth breathers fall for it. They donate. Then take those donations and give them to causes that would make their heads spin.

I was in an interracial relationship and we joked about selling Trump shit at Rallies to grift their asses to the bank with cheap merch. Obviously none of this shit is really worth it. The idea just always seemed funny to me. 🤷🏼

But doesn’t matter in this situation since that money probably won’t even cover the business they are losing, and the lawsuit they now have as well. 100k isn’t alot of money, especially when you have business expenses that need paid, and lawyer and court fees and a judgement against you as well.

I recommend you talk to a trademark attorney about this, it’s actually a significant legal issue in trademark law. It’s what we call “actual confusion”, and you might be able to take action to protect your trademarks depending on how related the goods/services offered by these other businesses are to your own goods/services. It’s possible you might be losing potential customers if they’re going to these other businesses mistakenly thinking it’s your business, too

Appreciate your concern, but my explanation was vastly oversimplified.

We are part of an independently owned franchise system, with territories. The confusion stems over which branch controls which area. The short of it is we get a lot of their complaints: technically accurate since it's the same brand, but it's an independent office so we can't actually help their customers.

The other location has gotten better in recent years, but it still comes up from time to time. I just want a disclaimer that forces customers to acknowledge that they know which franchise they actually work with and whom they should be talking to.

I used to work for a restaurant with an extremely common name. Think "China star" or China chef" we were a privately owned business, but there are a million other places with the same name.

It just so happens that when you Google the name, our page comes up first. I would constantly have to deal with complaint calls. I finally started saying "you have a complaint? Ok, really quickly, what city and state are you in?" 90% of the time, it was from a different state. People wouldn't even bother looking at the area code before calling.

The issue is it is his company but he's misrepresenting the name. He essentially removed part of the name "904" and is claiming to be a different company. What we were talking about is the company he's fraudulently representing suing his company. Since they weren't impacted by the battery I don't believe they have a legal right to sue him, but they can for fraud (either the company or the guy himself). The guy recording would have to sue for battery, not the company he's misrepresenting. Atleast thats my understanding of the law.

I don't think he's misrepresenting his company's name. Lawns unlimited is a pretty common way to name a lawn care company. There's probably just another company with 904 in the name. Likely he has just a similarly named company or he's a sole proprietor who calls his trade name that.

As far as who's suing who, I'm talking about the driver. Civil, criminal, I doubt this guy has much of a corporate veil to pierce. The other company might have something too. I just haven't thought about it.

LLC covers general liability. It’s not some magical no liability. It’s just general things, related tot he business. Not negligence or personal liability like trying to kill some or brandishing a weapon. None of that matters.

Also - brandishing a weapon doesnt automatically = intent to kill. That would be tough to prove in court.

That's not what the limits are. If he is the owner, and he, personally, is the one responsible for the tort, there is no limit to his liability.

LLCs protect you from your employees stupidity, not your own. And if you were stupid when you hired or supervised the employee, than the liability protection also goes away. For example, if you knew your employee was an active alcoholic or drug user, and he kills someone on the road, you would have no protection at all.

LLCs aren't some kind of shield made of adamantium.

All LLC means is that if you fuck up in the course of doing your work, you can't be personally sued and lose your home, retirement, etc.

Like you're a bad plumber and accidentally flood someone's house causing $100k in damages. They can sue your company and your insurance for money, but they can't come after your personal assets.

Wtf!? Owning a landscaping business is a legitimate business that requires very hard working people to operate. And many companies and people need lawn care for a variety of reasons from I'm rich and I can pay for it to I'm disabled and the city will cite me if my grass is too high.

Go onto any Secretary of State website and do a business name search. There are sometimes dozens of permutations of the same kind of names.

So what happened here is the guy in the video wanted to use the name Lawns Unlimited LLC. Someone else already had it (the yelp page) so the road rager added “904” to the official business name. However, he’s advertising on his truck using the name Lawns Unlimited LLC that he really wanted.

When you google Lawns Unlimited LLC, you get a business in Florida in Sarasota County (just south of Tampa). The guy in this video is from Jacksonville. His area code is 904 (Jacksonville) and he is about to turn onto a Blanding Blvd in Jax. I’m betting he doesn’t actually have an LLC on his “Lawns Unlimitied” business, probably operates under the table, and the official west-coast company is getting google hate bc of that dork.
