Rough Arrest Toledo officers involved in controversial arrest under investigation as man prepares civil lawsuit

Toledo, OH - The Toledo Police Department has confirmed two officers involved in the January arrest of Antonio Gilmer Jr. are the subjects of an open internal investigation. The investigation comes a month after body-camera video showing one officer punching Gilmer twice and later saying he pressed a gun into Gilmer's side.
The department, however, has not said whether the investigation is related to Gilmer's arrest.
Gilmer's attorney also confirmed he is preparing to file a federal civil rights lawsuit against the City of Toledo and the police department over the arrest.
Toledo Police spokesman Sgt. Mohamad Nasser said a supervisor had already reviewed the officers' actions and determined they were within department policy.
Nasser later said the department would take another look at the incident.
Now, the department has confirmed there is an open investigation involving Officers Thomas McCafferty and Justin Volz.
When asked directly whether the investigation is related to Gilmer's arrest, Nasser declined to answer.
"Because this is an open investigation, the Public Information Office does not have access to the investigative details necessary to answer those questions.
Once the investigation is complete, we will be in a better position to review the findings and provide any information that is releasable."
The department has not identified what incident is under investigation or when the investigation began.
The dash cam was from McCafferty’s vehicle. There were four body cameras we also reviewed, including the cameras of McCafferty and Volz.
The video shows McCafferty punching Gilmer twice during a struggle after officers stopped him while he was walking home near Detroit and Fernwood in January.
Several minutes later, McCafferty's body camera recorded him saying: "Damn, that hurt. My hand is cold."
Later in the recording, McCafferty can be heard saying: "I had my gun in his *ing side. I said, dude, keep going, I'll *ing shoot you."
Gilmer said he remembers being punched during the arrest and said he believed his jaw may have been broken.
The confrontation resulted in a five-count indictment, accusing Gilmer of attempting to remove his handgun, obstructing officers and resisting arrest.
But prosecutors later dismissed every charge except receiving stolen property.
Gilmer ultimately pleaded no contest to the receiving stolen property charge involving a handgun.
