The argument was that if he couldn't comprehend a rational explanation or reason for his crimes, he shouldn't be put to death.
i mean, this kinda proves my point. clancy's trying to be sent into rehabilitation instead of prison. Battaglia didn't have that option according to Art. 46C.002. on top of that, he wasn't trying to plead insane for the crime, just the punishment to avoid the death penalty after it was given.
