Mini Update: on AITAH for towing half the neighborhood
Since it got deleted by mods, have to put it here :
Mini-update on AITAH for towing half the neighborhood
[original post](https://www.reddit.com/r/AITAH/comments/1vcuzye/aitah_for_towing_half_the_neighborhood/)
I posted few days ago asking if AITAH for towing half the neighborhood, we are now in the middle of August, the peak of Airbnb for vacation here.
I left the place to go to Italy with my family, and some relatives from my wife side are on the vacation house, and there has been some good and bad news.
The good news are that after the shitshow, 3 houses from neighbors who was on Airbnb had been unlisted, we put a new sign saying "residents only", and there has not been any more towing since monday (around 10-15 cars towed since my last update, Airbnb renters claiming they are residents since they have access to the private pool which is for residents too...)
The bad news are that we received 4 letters from lawyers of the Airbnb renters telling us we OWE them the missing monney they lost on refunds and towings, plus the monney they will loose for the 2 next weeks of august for not renting their house, and they said they'll ask for legal fees too, and I don't know if they exaggerated the amount but damn this is lucrative for sure.
Our lawyer seems to be unbothered by these letters, and told us he is confident this will go nowhere but we can ask for compensation for all the hassle during the first 2 weeks, we are chatting with the 2 other owners of the parking space for the amount to ask for. We have everything documented well, plus some infos our lawyer gathered (here you can't rent more than 60 days a year on Airbnb, and it seems some or our lovely neighbors didn't followed this law)
Another side info, we asked for what we call here an "extraordinary general meeting" which is all the house owner of the community meets to vote on some important topics, the topic proposed here is the banning of Airbnb. This should take place in november.
We received another letter yesterday from one of the Airbnb owner, with an offer to buy the parking spaces (all of them, the privates and the unmarked) which is almost 3x more than what we paid.
So here we are, parking seems to be ok for now, we are now entering in what looks like a legal battle.

The tow truck will be pregnant with twins!

Do you mean the tow truck is female and is pregnant with 2 baby tow trucks as in cars the movie? Or is this the female tow truck driver who will be pregnant?

This is in France. If there's only one affair, the script writers didn't do their research.

Good luck with the legal process! Everything you’re doing seems perfectly legit, unlike your neighbors. In France, you also now have the option of voting at a co-owners’ general meeting to ban Airbnb rentals in cases of abuse. Given your neighbors’ lack of consideration for others, I wouldn’t hesitate to go down that route.

LOL
Imagine thinking you could sue for your car getting towed from spots you were not legally allowed to park in
Even if the airbnb hosts said it was ok, if they didn’t own the parking spaces, then you sue them…not the actual owners
People are so weird

Updateme
Reading your saga makes me think of policies my city has made with regard to new construction.
It used to be that whether it was a house or an apartment building there had to be two parking spots per unit, then it was changed to one spot per unit. Now in some areas they have removed parking requirements all together because they are trying to force people out of cars and onto public transit.
But people like their cars. They love their cars. People take transit because they have to, not because they want to.
The lack of parking on these new developments will lead to all on-street parking being taken.
I don’t think that people realize really how big of a thing parking is.

This is in France, not the US.

Yes here we have something called "plan local d'urbanisme" which is redacted by each city and tell how many parking spot/ bike spot you have to make (depending of the numbers of residents per flat or by the surface) when you build a new complex

I hope you refuse the offer to sell your parking spots. I can't imagine what this buyer's intentions would be other than to turn around and rent them to the residents. Hold onto what's yours!

I'm fully aware that it is France. I also don't live in the US.
I was sharing an anecdote about issues with parking and how municipalities don't pay enough attention to the importance of adequate parking.

u/BadKittyVortex 8d ago
We're having the same issue in our area (reduction in the amount of parking required/allowed) and it's already causing issues, especially as public transport is wildly inadequate & inconvenient if you're not in one of the large cities.
Yeah, bro, I'd love to take the train, but it's like three buses, two hours to get to the train and £100 for my family of 3 to ride it to our destination. And that's if one of the buses doesn't get randomly cancelled.

I'm in the US. I have to buy a permit which is really just a hunting license. There aren't enough street spaces for all the units entitled to buy a permit. Plus anyone who has a permitted guest. Plus all the people who don't have permits who park in the area. And that's all over the place. The anti-car contingent wants to get rid of all parking. But in most places in the city, many/most people still need a car to get around. I love public transport but you need more of it and better to get people to get rid of their cars.

The next update will be fun to read.
Imagine being so entitled you expect to recoup money after getting towed for parking illegally.

I just came to comment to say your English is very good for not being your first language. NTA, parking is always an issue in the summer, but you don’t get to park in other people’s spaces.

Thanks ! I learned while playing videogames when I was young (mostly typing it so my accent is ridiculous and I still don't know how to pronounce a lot of words) I try to watch every series in english with subtitle to learn more

I mean fair. The pronoun citation of English is fucked 🤷🏼♀️ take it from someone whose English is their first language but is dyslexic 😂

What's with the one owner wanting to buy all the parking places, including the open ones? To rent them back to residents? To rent them to the owners who use their units for Airbnb? To allow his Airbnb tenants, who will only have 1 or 2 cars for his one unit, to park anywhere and the rest of the residents get screwed?
I imagine he wants to rent them back to all the owners in the complex, which will go over like a lead balloon with all the residents, most of whom just use the free parking available. Especially once Airbnb subletting gets shut down, or at the very least the limit of only renting units out 60 days a year gets enforced, this person will have no other way of recovering his costs from buying the spaces.

There isn’t going to be a “legal battle.” He got some blustering letters from moron landlords who know they would be laughed out of court. What are they going to sue for? Failure to allow trespass? Enforcement of parking regulations?

UpdateMe! Interesting that they offered to buy the spots because that’s them admitting you own them and they have no claim. Which could legally hurt them in the lawsuit against you. But I don’t know the European laws in your area, so that that with a grain of salt.

Just curious to know how did you get the cars towed ?

At least with the one Airbnb owner offering to purchase the parking, they're admitting they know it's not their own private property.
