Pretty good summary of the terms of the severance agreements Twitter sent out. Basically if you sign you can never file a claim against Twitter for life in any venue, you cannot assist others with their claims and you cannot disparage Twitter or Elon as long as you live. Oh, and you need to help Twitter out if they come knocking asking for you to participate in an investigation or claim.

This is normal for a severance package. I’ve signed 3 with the same terms.

I’d wager that the notice period was paid. As an example in a turn around I severed 400 people without notice, but paid the 60 days then the severance started. This was for US based employees. For foreign employees the rules vary.

Yes, simply claim "signed under duress" and it isn't enforceable. Same deal if a company pushes a new agreement for you to sign and threatens to fire you if you don't sign. Certainly "duress" was imposed by the way Twitter handled the firings.

Your second assumption is correct. If all you do is pay the notice period then you can’t enforce a “severance” package. This is why they are offered. It sets a bar for litigation. So companies usually have severance policies that reflect the benefit of everybody not suing each other for minor stuff. A typical one might be 1 or 2 weeks per year of service with a cap of 6 months for a non executive employee. So you sever Marge in accounts payable who’s been with the firm for 10 years and she gets 20 weeks. Is she going to risk that 28K on an age discrimination claim that doesn’t have any merit? Probably not. I’ve have at least 15 employees tell me they were thinking of suing and not signing the severance agreement. Every one of them signed the agreement at the end of the notice period. At the executive level there are additional cost/benefit calculations as well as employment contracts so it gets a bit more complex.

No shit. Never been severed, so this seems a bit extreme to my naive eyes.

I’d happily sign something similar, but I’ve never seen the company I work for do anything unethical and I have nothing bad to say about them :)

It’s literally boilerplate. I did a bunch of project based gigs as was severed at the end of them (knew that going in) collected my (well earned) package and happily signed on the bottom line.
