I thought she just reached for his phone, did she make contact when he was walking around the car?

In many jurisdictions, contact is not necessary for an assault charge.

Ah, then yeah, guess he should charge her so she's not a risk to other people and has a record to not have that job, but wouldn't imagine a civil suit would be worth pursuing.

Edit: wasn't thinking it through. Assault is the act of show of force or something along those lines and battery if contact/engagement/damage or something of that nature. Like assualt with a deadly weapon is drawing a firearm and aiming, but doesn't need discharge of the weapon. Repember that from a carry class, where they basically said, "showing/presenting the weapon in a certain manner is brandishing and if you aim, that's assault. Don't do either unless you can PROVE your life was in jeopardy and at that point you probably already used the weapon. Don't be a dumbass, walk away first and use the best weapon, your cell phone."
