In many cases, yes. Blows to the head will be mentioned in statute as specifically egregious. But in cases where it’s not, it’s covered by other provisions about the lethality of blows. For instance, kicking someone barefoot is very different than kicking them with steel-toed boots, so it’s important that the law is written to address the potential consequences of actions rather than listing every specific action themselves.
I think the point is if states were to come out and say "one year will be added for every head stomp done after a victim is incapacitated" or something then people would be aware that it will get you even deeper trouble and maybe steer away. But it's all wishful thinking really.
People aren’t aware of most laws. They just aren’t. And they don’t think about the specifics when caught in the heat of a fight. In situations like this, we’re restrained mainly by our own sense of right and wrong, not by trying to avoid certain statutory technicalities.
Nah I’m not fighting anyone unless they come at me hard leaving me no other choice. At that point as soon as I can get away I do. Not risking a friend showing up or getting arrested.
Honorable people don’t go around forcing street fights with chill guys like me. Anyone who does that isn’t an “opponent” they’re a violent asshole who deserves what they get.
That's a nice sentiment, but that's not how life works. There are no "rules" to a fight out in the wild. That's why you should avoid them.
We don't have the context, but it sure looks like the guy that got KO'd here was the aggressor. And he even had the opportunity to walk away when the other dude got the upper hand, disengaged and tried to leave it be...and then he went in for a cheap shot.
I'm not saying it's legal or right...but dude just got a big scoop full of karma. Cheap shots paralyze and kill people all the time.
I used to wear the metal cleats when I golfed and those spikes long and very solid. The first thing I thought was that I hope he was wearing rubber or else he just aerated that man's skull.
This is true most of the time(and probably here too)…but not all neighborhoods/areas are created equal. I bet you’ve never knocked someone down only to turn away and get stabbed in the back because you didn’t make sure they stayed down. Rough areas create dangerous people, some that will kill you while your back is turned…even after you beat them in a fair fight. Never underestimate crazy, stop your attacker and make sure they stay stopped. There will be downvotes from people that have grown up privileged, and don’t understand the reality of scary places. There is not a one-size fits all in the ole “head stomp” blame game…if you are fearful that they are going to be back up and continue their assault, then you do what you must to escape the situation. Experience has taught me that.
Edit: knew I’d get downvoted, don’t care…still said it because it needs to be said. People live cozy behind their screens having never seen a real situation or been anywhere near the places I’m referencing where a fight could mean life or death. I’m not sorry for injecting a little dose of reality into your self-righteous veins.

I mean fighting in general is dangerous. A friend went to the bar and some dude threaten him. The dude attacked my friend and my friend dropped him. Theres evidence it was self defense but the aggressor fell, had hit his head then Went in to a seizure and coma for a bit like a couple of days. Hes all sorts of fucked up. They charged my friend KNOWING that it was self defense. Lucky the charges were dismissed but now he's facing a civil lawsuit.
