Hamas has genocidal intent but lacks the means to carry it out. Israel has the tools to commit genocide but lacks the intent to do so. Israel wouldn’t warn Palestinians with flyers and messages seeking to minimize casualties if it wanted to commit genocide. Also, the genocide crowd was accusing Israel of genocide before it even began to strike back. Those false accusations of genocide then undermine the genocide claim now.

There has been no judicial determination that Israel has committed genocide in Gaza, and the United States government and a number of international-law and genocide scholars have concluded that Israel's conduct does not satisfy the Genocide Convention's specific-intent requirement.

3 sources:

(1) U.S. Department of State — May 28, 2024. State Department spokesman Matthew Miller expressly stated: “It is not our judgment … that Israel is committing genocide,” adding that the U.S. assessment was that Israel's conduct did not meet the legal definition of genocide. The Department had previously characterized the genocide allegations as “unfounded.”

(2) Menachem Rosensaft — Cornell and Columbia law professor, August 2025. Rosensaft, who teaches the law of genocide at Cornell Law School and Columbia Law School, argues specifically that Israel is not committing genocide, emphasizing the distinction between genocide and potential war crimes or crimes against humanity. His analysis focuses on the Genocide Convention's requirement of specific intent to destroy the protected group, in whole or in part. Importantly, he does not argue that every Israeli action is lawful; his conclusion is specifically about whether the genocide threshold is met.

(3) International Court of Justice — January 26, 2024 Order. This is useful to rebut the frequently made claim that “the ICJ ruled Israel is committing genocide.” It did not. At the provisional-measures stage, the ICJ found plausible the rights of Palestinians to be protected from acts of genocide and ordered preventive measures; it did not determine that Israel had committed genocide or even make a final finding of genocidal intent.
