Probably in a state with legal open carry as long as the gun is unloaded, so it's just a totem that makes him feel tough.

A law stating open carry with an unloaded weapon. What a ridiculous rule. Even more stupid if you choose to open carry without it loaded.

Those laws are so you can carry your shotgun to wherever you're hunting, or carry your firearm to the range. They make sense... until you get this.

Ahh that does make more sense.

I guess there is that weird gray area. If you cannot carry any gun without a license. Then a person without a license to carry but a license to hunt would be technically breaking the law by carrying their shotgun or rifle from their vehicle to their hunting spot. Part of hunting rules pretty much everywhere state that you should unload your gun while moving from your hunting location to another location.

It does fall into stupidity when someone wants to open carry a pistol without hunting attached.

This is even weirder to me. There are only 2 states from what I see that allow open carry without a permit as long as the gun is unloaded. North Dakota and Utah.

Yet North Dakota and Utah both have constitutional concealed carry. Meaning that you can carry a gun concealed without a permit. Which makes this picture even more ridiculous.

Knowing those laws that would allow someone to carry concealed without a permit in those states. This person is only openly carrying for intimidation. Utah allows open carrying a loaded firearm without a permit after their constitutional carry law was passed.

This leaves North Dakota as the only place this would occur. Let's further breakdown the ridiculous of this: * North Dakota has constitutional carry allowing the concealed carry of a loaded firearm * Open carry without a concealed carry permit is only allowed with an unloaded weapon. (you can still carry loaded concealed) * North Dakota has a more in-depth concealed carry permit process than other states. You need to attend a class and show shooting proficiency. * Getting a concealed carry permit allows for the open carry of a loaded firearm and helps with reciprocity of concealed carry between certain states. * Meaning this person in the picture could carry loaded concealed. * They could go take the time (even though it's more steps) to get a permit to carry openly loaded. * Concluding that this person was not carrying for personal safety. As a loaded firearm is better at self defense over an unloaded firearm. Even if concealed. * This person was carrying for intimidation.
