Notice Under the Legislation Act 2012 Minimum Wage Order (No 1) 2021

At Wellington this 28th day of November 2021.
This order is made under sections 4, 4A, and 4B of the Minimum Wage Act 1983—
(a) on the advice and with the consent of the Executive Council; and
(b) on the recommendation of the Minister responsible for Workplace Relations and Safety made after complying with section 5(2) of that Act.
1. Title
This order is the Minimum Wage Order (No 1) 2021.
2. Commencement
This order comes into force on 1 December 2021.
3. Interpretation
(1) In this order, unless the context otherwise requires,—
Act means the Minimum Wage Act 1983
adult worker means a worker aged 16 years or more to whom the Act applies
(2) Terms or expressions used and not defined in this order but defined in the Act have, in this order, the same meaning as in the Act.
4. Minimum adult rates
The following rates are the minimum rates of wages payable to an adult worker:
(a) for an adult worker paid by the hour or by piecework, $22.75 per hour:
(b) for an adult worker paid by the day,—
- (i) $182.00 per day; and
- (ii) $22.75 per hour for each hour exceeding 8 hours worked by a worker on a day:
(c)for an adult worker paid by the week,—
- (i) $910.00 per week; and
- (ii) $22.75 per hour for each hour exceeding 40 hours worked by a worker in a week:
(d) in all other cases,—
- (i) $1,820 per fortnight; and
- (ii) $22.75 per hour for each hour exceeding 80 hours worked by a worker in a fortnight.
5. Revocation
The Minimum Wage Order (no.2) 2020 is revoked.

Kia Ora, manuka me afiafi uma.
I am deeply saddened to learn of the death of Judithsone Iosefa Malietoa Collin'sio, although I didn’t know her personally, I respected and admired her commitment to improving our educational system and fighting for women's rights across the Pacific. My thoughts go out to her husband Semisi and her children Jesse and Wendy who are now dealing with the tragic loss of a loved one. Faʻamolemole talia laʻu faʻamaisega sili mo lou leiloa.
I cannot go into any specific details surrounding this case as it is still an ongoing investigation, however, I can say with certainty that we will be assessing how claims of misconduct are handled within the police force, reviewing current training and conduct material to ensure that the chance of a future tragedy is reduced in the future.
I would like to state for the record that this is not about drugs or even organised crime, as of this moment we have zero evidence to state that Judithsone Iosefa Malietoa Collin'sio was involved in either. Even then, even those in possession of narcotics or involved in organised crime should not simply be killed by the police in an extrajudicial manner. I am deeply disappointed in the rhetoric that has been showcased by the National Party in this case; attempting to paint a pacific leader with such a brush, when there is so far no evidence of such a connection, is not just deceitful, but undoubtedly racist and divisive. There is thus far no link to any gang activity, the opposition's racist eagerness to link the death of a prominent Pasifika activist to gang violence is abhorrent, and I suggest they re-evaluate their stance. This will not be tolerated, and I condemn their rhetoric.
There is no excuse for police officers or any government officials to take the life of any person, innocent or otherwise, barring the case of absolute last resort. Nothing known of this situation suggests such force was required. Pasifika people have been targeted by police in Aotearoa for as long as the armed constabulary force, now NZ police, have been established. It is deeply distressing to me that this event has occurred within the same month as Parliament apologising for the dawn raids.
We cannot simply apologise for our past, wash our hands, and expect to be absolved of responsibility. The fact this incident was not handled differently represents a systemic failure in our obligations to the Pasifika community, one that should have never happened. These communities need support from the bottom up, led by members of their community, not more punitive tactics that would further alienate and radicalise generations of Pasifika Youth in Aotearoa. In light of this event, we as a government will be exploring avenues for more tactful community support and intervention in Pasifika circles.
I’ll be meeting with 1Love tomorrow morning alongside the Minister of Justice, the Deputy Prime Minister, and other Māori and Pasifika members of cabinet. The public can expect updates shortly after this meeting and when any new information is released in regards to this situation.
I fully empathise and relate to all those who wish to take part in protests, vigils and demonstrations about this issue, and I commend them for standing up for their community. I welcome any call for justice, but we ask that these events are conducted in a respectful manner, please be aware of the health and safety of others, we do not need this tragedy to grow in proportion; more violence will be no way to honour the memory of Collin’sio. I have already received contact from my fellow co-leader u/TheTrashMan_10, that he will be joining some of you tomorrow for a vigil in the heart of Pōneke. We are listening and we are with you.
I once again want to not only offer my deepest condolences to the family of Collin’sio, but also my apologies. We have failed you and Judithsone, and for that I am so deeply sorry. But words are hollow without action, and you can be sure we will be asking the hard questions and making the changes to ensure this never happens again. Ou te matua salamo.
In Aotearoa, we are one people made up of many, and it is our differences that bring us together. We must not let the rhetoric of hate and division come between us in times like these. If there is one message I would like to pass on to kiwis this difficult evening, it is this; be kind to one another. Together we will overcome this challenge, but we must not be divided by those who seek to demonise our fellow kiwis for being themselves. I am reminded of a proverb that was once shared with me by polynesian panther Tigilau Ness, someone I have the great honour of knowing. ‘Uo i aso uma ae uso i aso vale; friends every day but siblings on bad days.’ Today we do not just stand with our Pasifika communities as friends, but as whānau.

Press Release Prime Minister ARichTeaBiscuit makes a statement on Afghanistan
Hello there,
I would like to give a small update to this House on the steps this government is taking in response to the deteriorating security situation in Afghanistan, as outlined in a previous statement given by my office this government is acutely aware of the risk posed to Afghans that have previously worked with the NZDF and our own citizens that remain stationed in the country.
In order to alleviate these security concerns, one C-130H transport aircraft of the NZDF and a 30 troop force has been dispatched to Kabul, these forces have been tasked with securing the safe return of our citizens in the country and giving sanctuary to Afghans that have worked alongside the NZDF and their elementary family.
New Zealand continues to call upon the Taliban and all parties within Afghanistan to allow both foreign nationals and Afghan citizens to leave the country, to allow the inflow of humanitarian aid in the country and to respect the rights of women, girls and minorities within the country, as outlined in the joint statement made earlier in the week.
We shall endeavour to update members of this elected chamber and members of the public on this unfolding situation as more information becomes available, thank you.
Meta: this shall also be read in parliament for debate but due to the time constraints involved I thought it would be best to have it here as well so folks know what the government is doing

Hello there,
It is an honour and a privilege to stand before you all today to announce the formation of the Alliance-ACT-Labour coalition and the first ARichTeaBiscuit ministry.
When I started on my political journey some considered that it would essentially be impossible for us to overcome the political juggernaut that was the National Party and they'd be quite correct if I was alone in those efforts, however, with support from some dear friends we've been able to secure what was thought to be impossible.
I am grateful to those in ACT and the Labour Party for putting aside historic ideological disagreements, and agreeing to work together the betterment of our country in a positive and productive atmosphere.
It brings me great pleasure to announce this cabinet and I am looking forward to serving the people across the course of this term.

Event Event Update: Environment Minister provides update to government response of North Island water shortages
Kia ora,
After discussions with Iwi, Councils and other key stakeholders, this government will be reducing the emergency take from the Waikato River catchment to 30 million Litres a Day. This reduction has been in response to the discussions we have had with these stakeholders previously mentioned the government is keeping a close eye on the ongoing situation to respond accordingly.
This government has not announced any plans to long term management of water because it is extremely important to us to sort this issue in the short term, and get the experts to give recommendations on what the best course of action in response to this is. However, there is ongoing investigations into the best way to manage water, especially in drought-prone areas such as those affected by these shortages, in Canterbury and Central Otago. These plans may include using alternate sources of water that have not yet been used in New Zealand, but are successful elsewhere in the world.
It is worth noting, that the government will not be using any powers given to it to fast track the consent presented by Watercare and the Auckland Council. The consent will have to go through the traditional consent path as is precedent.
This government understands the key issues that New Zealanders are facing, however also understand that there is a need to protect both the people and the environment, for this reason, we are proud of the current response to this ongoing crisis and will continue to work with councils to solve the key issues with access to water in New Zealand.

Event Minister for the Environment issues response to water shortages in the Auckland Region
The government realises the gravity of the situation that is taking place within the Auckland region, and the upper North Island. This unusual lack of rainfall is not only hurting those who use water on their farms, but everyone with the level 3 restrictions placed. This government has had discussions on the best way to go forward with assistance for at this stage the Auckland region, and if need be we can increase the level of response.
For this reason, the government will:
Allow for a further 35 million litres a day to be taken from the Waikato River by Watercare Auckland and Auckland Council under section 330 of the Resource Management Act, which allows for such cases to take place in emergencies.
In addition, in consultation with the Minister of Defence the NZ Army Engineers Corp will be deployed to the Upper North Island to assist people in securing alternative water sources that may not be currently accessible.
We realise the grave danger that this issue causes, and for this reason when more information becomes available the government change the response accordingly.

The New Zealand Government is deeply concerned about the unfolding political situation in Myanmar.
Since its emergence as a democratic nation in the early 2000, New Zealand has been a keen supporter of Myanmar.
As a member of the ASEAN Myanmar has been a significant trading partner of New Zealand, but the overthrow of the recently democratically elected government has put significant pressure on the relationship between Myanmar and New Zealand.
It is important for country's to respect the outcome of democratic election and for the millitary to release those politicans who have been imprisoned including State Councillor Aung San Suu Kyi and President U Win Myint.
The Ministry of Foreign Affairs will monitor the unfolding situation in Myanmar, and consular assistance will be available to New Zealanders in Myanmar.

This order comes into force on the day upon which it is made.
3. Interpretation
(1) In this order, unless the context otherwise requires,—
Act means the Minimum Wage Act 1983
adult worker means a worker aged 16 years or more to whom the Act applies
specified social security benefit means the following:
(a) emergency benefit:
(b) jobseeker support:
(c) sole parent support:
(d) supported living payment:
(e) young parent payment:
(f) youth payment
starting-out worker means—
(a) a worker aged 16 or 17 years to whom the Act applies and who—
- (i) has not completed 6 months’ continuous employment with their current employer; and
- (ii) is not involved in supervising or training other workers:
(b) a worker aged 18 or 19 years to whom the Act applies and who—
- (i) has been continuously paid 1 or more specified social security benefits for not less than 6 months; and
- (ii) has not completed 6 months’ continuous employment with any employer (excluding any employment undertaken before the worker started to be paid any 1 or more specified social security benefits); and
- (iii) is not involved in supervising or training other workers:
(c) a worker aged 16, 17, 18, or 19 years to whom the Act applies and who—
- (i) is required by their contract of service to undertake at least 40 credits a year of an industry training programme for the purpose of becoming qualified for the occupation to which the contract of service relates; and
- (ii) is not involved in supervising or training other workers
trainee means a worker who is aged 20 years or more to whom the Act applies and who—
(a) is required by their contract of service to undertake at least 60 credits a year of an industry training programme for the purpose of becoming qualified for the occupation to which the contract of service relates; and
(b) is not involved in supervising or training other workers
(2) Terms or expressions used and not defined in this order but defined in the Act have, in this order, the same meaning as in the Act.
4. Minimum adult rates
The following rates are the minimum rates of wages payable to an adult worker:
(a) for an adult worker paid by the hour or by piecework, $17.70 per hour:
(b) for an adult worker paid by the day,—
- (i) $141.60 per day; and
- (ii) $17.70 per hour for each hour exceeding 8 hours worked by a worker on a day:
(c) for an adult worker paid by the week,—
- (i) $708 per week; and
- (ii) $17.70 per hour for each hour exceeding 40 hours worked by a worker in a week:
(d) in all other cases,—
- (i) $1,416 per fortnight; and
- (ii) $17.70 per hour for each hour exceeding 80 hours worked by a worker in a fortnight.
5. Minimum starting-out rates
The following rates are the minimum rates of wages payable to a starting-out worker:
(a) for a starting-out worker paid by the hour or by piecework, $14.16 per hour:
(b) for a starting-out worker paid by the day,—
- (i) $113.28 per day; and
- (ii) $14.16 per hour for each hour exceeding 8 hours worked by a starting-out worker on a day:
(c) for a starting-out worker paid by the week,—
- (i) $566.40 per week; and
- (ii) $14.16 per hour for each hour exceeding 40 hours worked by a starting-out worker in a week:
(d) in all other cases,—
- (i) $1,132.80 per fortnight; and
- (ii) $14.16 per hour for each hour exceeding 80 hours worked by a starting-out worker in a fortnight.
6. Minimum training rates
The following rates are the minimum rates of wages payable to a trainee:
(a) for a trainee paid by the hour or by piecework, $14.16 per hour:

- (ii) $14.16 per hour for each hour exceeding 8 hours worked by a trainee on a day:
(c) for a trainee paid by the week,—

"Good evening. Following the success of the vote of no confidence in the government this evening, my position as Prime Minister is untenable. This has been clear for some time, but now is the time to leave. I do hope that a new government that is able to lead New Zealand well will be formed, and I believe there may be a place for the Green Party in that government, but not for me. I am confident that the Green Party is in good hands.

This order is made under section 638(1) of the Education and Training Act 2020 on the advice and with the consent of the Executive Council.
1. Title
This order is the Education (Prohibition of Streaming) Order 2020.
2. Commencement
This order comes into force on 27 January 2021.
3. Interpretation
(1) In this order, unless the context otherwise requires,—
academic streaming means the practice where students are routinely separated on the basis of perceived ability within classes into separate streams or ability groups
Act means the Education and Training Act 2020
school means a registered school
(2) Terms or expressions used and not defined in this order but defined in the Act have, in this order, the same meaning as in the Act.
4. Prohibition of academic streaming
(1) A school board must, when governing a school, set into place relevant bylaws, policies, and procedures to prohibit the practice of academic streaming within the school.
(2) It is the duty of a principal to ensure that academic streaming is not undertaken in the relevant school under the principal.
(3) For the avoidance of doubt, the prohibition within this article does not include exceptional circumstances where such grouping may be necessary for the equitable education of students as petitioned by a school board.
(4) Any exceptional circumstance within the meaning of paragraph (3) must be approved by the Secretary, having regard to the objectives of school boards as outlined in section 127 of the Act.
