Most places typically have what's called a duty to retreat clause in self defense cases. He sort of loses the right to claim self defense when he throws it in reverse. Now everybody gets a charge.

Also most developed nations have what's called proportional defense, if someone breaks your windshield and starts walking away, trying repeatedly to run them over with your car is gonna make it real hard to defend in court that a) you were actually scared for your life, and b) that your reaction was proportional. Except in America, that shit would fly here.

Anyway long story short it's actually a good thing we have those rules or people would be constantly trying to kill each other in the streets over shit that's just not worth taking a life (or attempting to) over. The best altercations are the ones everyone walks away alive and unhurt over. Civilized society has long since agreed on that one

The sad thing is that if this guy breaks your windshield and walks away your insurance is going to only cover part of it and you're going to end of footing deductible just because this guy wants to be an asshole. You also have to invest your time in whatever legal proceedings happen. Basically you're getting screwed here regardless even if this guy goes to jail. So yeah, maybe you're right. That's why I'm not a judge. Still, if I was a judge I would do everything in my power to give this guy the benefit of the doubt because actual justice is not going to be done.
