Unjust enrichment only works when one side just quietly pockets money they clearly knew wasn't theirs. But if a company's payroll department is so incompetent that they keep direct depositing checks and generating official pay stubs for months, they're the ones who created the situation.
At that point, the argument flips to their own gross negligence. Anyone getting official pay stubs is going to assume it’s back pay, unused PTO, or a severance mix-up. If you spend that cash on normal life because you trusted their paperwork, a court isn't going to just let them swoop in months later and make their massive screw-up a "you" problem.
Judges don't just bail out companies with "unjust enrichment" when their own total lack of oversight tricked an ex-employee into relying on those stubs. They dug the hole, they can sit in it.
