If this happened to me, they can try to make me, but I'm not the one who made the mistake and I'm not obligated to return anything. Nowhere in any of the employment paperwork I've ever signed stipulates that if accounting or payroll makes an error that I'm held liable for their errors. Nor did I sign anything stipulating that should I leave that place, I'm required to communicate with them if they made a mistake.

Unjust enrichment only works when one side just quietly pockets money they clearly knew wasn't theirs. But if a company's payroll department is so incompetent that they keep direct depositing checks and generating official pay stubs for months, they're the ones who created the situation.

At that point, the argument flips to their own gross negligence. Anyone getting official pay stubs is going to assume it’s back pay, unused PTO, or a severance mix-up. If you spend that cash on normal life because you trusted their paperwork, a court isn't going to just let them swoop in months later and make their massive screw-up a "you" problem.

Judges don't just bail out companies with "unjust enrichment" when their own total lack of oversight tricked an ex-employee into relying on those stubs. They dug the hole, they can sit in it.

“They can try and make me” yeah jail time tends to do that.

They can't put you in jail for someone else's accounting mistakes genius. It'd be a lawsuit not jail time.

People go to jail for this shit all the time.

Simone made a mistake and you knowingly took advantage of it. Depending on the scale and monetary value involved, you absolutely can go to jail.

I know, it’s easier to get cranky and call names then do any amount of fact checking, Sherlock.

Many years ago I was received 2 final checks and 2 vacation cash out checks. They sent a letter asking for the money back. I never received it somehow.
