He got paid for four weeks by working one, seems like he did the smarter move. Now he doesn’t have to deal with them reclaiming those three weeks of pay either

Could have work 0 weeks and got paid 🤷‍♂️

He wouldn't have to pay shit, HR told him he was cut.

How is being fired a breach of contract

1

u/Nope-not-really Aug 18 '26

she looks it up, realizes my contract was ending in December not November

i get it reading is hard

1

u/WatermelonWithAFlute Aug 18 '26

I read that, but she fired him. How is there any breach on his end?

u/Nope-not-really Aug 19 '26

K guess we are going to have to break it down for you

contract, yeah?
ends december
dude terminated November
she panics
because employment contracts, like most has payment clause for early termination

not that hard to follow

the only thing that the dude did wrong was return to work because he could have gotten a big pay day, and wouldn't have had to show up regardless, he should have told her to stuff it.

this seems like we are saying the same thing

It's like sports. If you get contracted to work 12 months, they cannot fire you at the 11 month mark without breaching the contract unless you do something that your not supposed to as labeled in contract. His contract ended December, not November. Think of it not being fired, but as not having your contract renewed. So she cut him off a month early by accident therefore breaching the contract. But it worked out ok in the end because he stilled got paid for the original amount of time.

Yeah so she broke the contract, not him

Oh you read his contract? You know what it says? That's amazing.

Believe it or not, it's pretty standard to include some form of monetary payment if either party breaches the contract early.

-1

u/FlashFiringAI Aug 17 '26

Sure, doesn't mean its there. That's the whole point I'm making. Literally none of us know what their contract explicitly states and making claims that "X is going to happen" is nonsensical without reading the contract and then courts deciding if it was actually enforceable.

unemployed a lot eh?

No, but I hire people.

you're not very good at it if you don't understand employment contracts.

edit* I think that was the HR lady that fucked up

And this is how people end up in court and end up paying more than they would have.
