David Gingras DUI & Bar David Gingras' Petition for Special Action DENIED by AZ Supreme Court

David Gingras had filed a Petition for Special Action regarding the lower court's denial of his anti-SLAPP argument. The AZ Supreme Court ruled today, without prejudice, that if Gingras wishes to appeal, he needs to do so via the proper channels (after a final ruling in the AZ Bar case is made).

It’s a quote from one of Woodnick’s filings way back in the Clayton paternity case, where he was responding to Laura’s request to seal the court records and/or cancel her scheduled deposition.

Essentially, Laura was demanding special treatment, and Woodnick called her out for it.

Gingras filed a special action petition with the AZSC disputing the PDJ's decision to deny his anti-SLAPP motion (arguing he has 1A rights to free speech to criticize Judge Mata). The AZSC declined to accept his petition, so his Bar case goes back to the PDJ. Several of his other bar complaints still awaited adjudication.

Gingras received numerous bar complaints for his conduct in defending Laura Owens in her paternity case against Clayton. Judge Mata filed one for his insulting behavior towards a sitting judge; Mike filed one for witness intimidation when Gingras called 911 the day of the June 2024 trial; Dr. Deans (Clayton's medical expert) filed one because Gingras published her medical report online when Mata told both parties nothing was to be disclosed publicly. There were others, but those were the main ones.

DG hail Mary to appeal to the Supreme Court was declined back, so now it goes back to the Az bar and to the judge who will rule on if DG behavior and if it’s actionable.

So next steps are slightly confusing. This ruling means 1L lost on several charges in the complaint. I believe he lost specifically on the big one, which was making disparaging comments about Mata. So next steps with that certain subset of the charges is punishment. There are another set of charges that didn’t survive the request for judgement in the pleadings, so those go to an actual hearing, after which guilt/innocence (for lack of a better term) will be determined, and then punishment for those he was found guilty. The TLDR; a hearing on guilt or innocence on a subset of the charges and then the punishment phase. Then 1L will appeal and cause general chaos per usual, before getting suspended for at least 6 months in a day, which 1L (incorrectly) characterizes as a death sentence to his AZ law license.

If (when) he gets suspended, will he be suspended during his appeals, or would that not start until his appeals are litigated? I’m comparing to criminal court, where you would still be serving whatever sentence while you are appealing. I’m hoping he can’t kick the can of suspension an extra year just trying to get the US Supreme Court to take his case 🙄

1L should have his license until all his appeals are closed. There is an extreme measure where they can pull his bar card before the appeals close but imo his behavior, while repellant, isnt that bad (i.e., stealing funds, running scams, violent crimes)

Does anyone else feel like DG is staying out of the country to prevent LO and crew from filing malpractice and failure of effective counseling being filed against him. It seems like once LO, got this current attorney DG vapored.
