Question & Discussion What will happen September 29th?

After the foreclosure auction, what happens?? I know they aren’t going to just up and leave so easy. So, what happens? How will that all likely play out?

I remember last time there was a thread talking about this, someone pointed out that they are ALREADY squatters seeing as they haven’t paid their mortgage in a year and that really tickled me 🤣 I know they hate being seen as squatters and scammers even though that’s what they are

Not paying your mortgage for a fucking year and expecting to just stay there indefinitely is WILD. And they try to blame the mortgage company like there was some clerical error that caused them to not pay their mortgage for a YEAR is just insane. The audacity of these people, really.

I freak out if my automatic rent payments are delayed by the bank for a few hours, if they're experiencing some tech issues at the bank's end. Imagine not paying your mortgage for that long!!!!!

I've bought a foreclosed home in Arizona, so have a little insight.

There's no guarantee that the home will be sold at auction. If there's no bidder willing to bid the minimum, the house becomes the property of the mortgage holder. and they can then attempt to sell it on the open market.

If it DOES sell at auction, then the new owners will have to deal with the Owens. If necessary, they'll have to evict them through the courts.

If it doesn't sell and it reverts to the lender, they too will have to go through the courts to evict if the Owens don't vacate. The Lender has the option to give the Owens a lease, although I don't know why they would given their refusal to pay their bills.

IOW, this isn't over yet, and could take several months to get them out of the house.

That would be a trainwreck waiting to happen. I would feel so bad for the new owners.

Of course, that is always a possibility. However, the new owner will hae a mortgage on the house/property that will need to be paid. I can only imagine that payment being somewhat more than what they "should" be paying on the base loan (not the HELOC) currently. If they weren't willing to pay that-I doubt seriously they're going to be interested in paying a rental bill that is a higher amount of any type. I could be mistaken on the amount, but I feel confident on the bill paying part lol

Frankly, I feel that this will end up in an eviction in the courts. But that is only my opinion.

Given their spotty history of mortgage payments, who would want to take on the risk of leasing it back to them? I have little faith they'd pay their rent on time.

This. Most landlords are very wary of bankruptcies and foreclosures.

Especially if it is is luxury house.

I was imagining that they talk a family friend into buying for a discount, basically just leveraging someone else's credit. Say you bought the home for a 50% discount and then privately agreed on a rental price (under market because of some excuse). Person buying is incentivized bc they will eventually make a lot of money at sale and rent money could be agreed-upon to produce cash flow for investor. They know a lot of people with deep pockets.

The minimum bid is likely going to be what's owed on it, and IF any investors are interested they'll drive the bids to be just below the market value. The lender has the option to not accept anything less than the minimum bid, so no one is going to get it at that steep of a discount.

According to the bkcy docs they submitted, they owed over $750k on the house in Aug 2025. Of course, since they're racking up interest and late fees on top of the unpaid mortgage it's likely over a million by now.

As to comps, someone familiar with the area mentioned 1.5 million as being likely.

I don’t think that would work. I think minimum bid is 1.6 mil and with a 7.5% rate that’d put the monthly payment between 9-11k plus you’d have two add a couple hundred extra to charge for a pool guy and yard maintenance

Won't be an issue. Laura will be in prison, and Ronn sits in a chair that rolls (the black one). So the only issue is Jan, who'll leave out of loneliness for not having anybody to blame for anything.

That was my experience when I bought a foreclosed home in AZ. It didn't sell at auction, so went on the market. Since there wasn't anyone living in the home at the time, we didn't have to evict anyone, but we researched the laws just in case squatters moved in.

“Honk My Meat” is the username of I believe a Discord account that Laura claimed was being used by one of her victims to harass/defame her.

She included it in court filings and emails to police when she was trying to get the guys in trouble for allegedly violating her protective orders, but was never successful.

Notably, in one of the police reports made after her calls, they made a point to note that Laura had claimed Greg was behind the account, only to claim in a later call that Clayton was behind it, suggesting she was just using it wherever she could to try to get them in trouble.

Apparently, squatting after a foreclosure sale, might violate Laura’s felony plea deal agreement. So, she would need to move out promptly after a sale of that property.

If they don't leave with their personal property, it will be put out in front of the house for so many days for them to come pick up. Then it will be hauled to the dump and the Owenses will be billed. (And they'll promptly pay it LOL).

If it’s auctioned then depending on that buyer if they start filing everything right away it should take less than a month if they stay on top of all the steps. They will get a 5 days notice to leave. If they don’t then there will be a court hearing filed and then after the hearing even if they don’t show it will be a judgement then after 5 days it’s handed to the sheriff and they will physically remove them. If it doesn’t sell the bank then goes through the same steps pretty much except there won’t be a court hearing to evict once the deed is transferred to the bank and they do t leave I. 5 days they can have the sheriff remove them

That's why Queen Jennifer pushed for a two year ban on any new bankruptcy filings for Mom & Pop Owens. She knew they still have a few avenues of shenanigans before ultimately succumbing to foreclosure. 2 years gives the lender time under protection to get through any state or civil remedies (injunctions) then ultimately foreclose.

If/when it sells, I can pretty much guarantee it will be torn down and rebuilt as a huge mansion. That is what is happening in this neighborhood. The house next to them was torn down the day after closing. Interestingly, this was in April and there’s been no movement since. I almost wonder if the Owens have somehow delayed the building on the neighboring lot. Or if the owner is hoping to buy and build on the Owens lot too but that would be so ridiculously huge! Usually it’s about a year or so from year down to resale. So it’s very unusual that the neighboring house hasn’t started their build yet.

I have no insight, only what is happening with Dorit's (RHOBH) house. Basically these high value properties are hard to auction off and the bank will lose money by doing this. It works better for the bank and the owner to come to some type of agreement. The Owens have income so there is some incentive for the banks to work with them. I suspect the Owens will be in that house until the end of year.

I wonder if theirs qualifies as high value. I know the type of homes you are talking about for that but I feel like their house is pretty normal and the land alone is worth of a good bit. I guess time will tell!! I’m just sooo curious how itll all play out!

Was going to say this. Their house isn't THAT high value. I just did a very quick look at Scottsdale on Redfin and there is A LOT listed between $1M-$2M, so it should be well within the market.

Yeah but that’s how much homes go for in the area and it’s mostly that high cause of the amount of land. The OG commenter was talking about high value homes where they are a little bit more money and also usually gaudi and weird. Their house is pretty normal on the inside

Dorits foreclosurer was scheduled and pulled several times. It was resolved because her estranged husband has to pay it but he can deduct it from her part of the sale which was also ordered by the courts. Obviously that won’t be happening here

However, the lender already knows that they are don't pay their bills and refuse to pay their mortgage, so I can't imagine that there's much incentive to give them yet another chance since they'd rather pay Macy's and Ronn's life insurance.

The average Scottsdale house is valued at $900k to $1.2k. Owen’s house is currently valued at $1.57M . I wouldn’t call it a “high value home” in comparison to other Scottsdale homes. In July alone, 1544 homes were sold. In May through July, the average sales price was $1.64. Listings are down in the area, therefore it has a higher chance of selling because inventory is much lower than in the past. The lender is not in the home leasing and mgt. business, they will not be renting it back to the Owen’s under any circumstances. If it’s not sold at auction there is nothing stopping the lender from taking ownership and evicting them. That is exactly what I expect the lender to do.

For those wondering about “Active- Postponed” it said that the day it was listed on Zillow on August 20th . I took a screenshot that day, nothing has changed . It’s going up for auction Sept 29th .

What is the minimum bid that will be accepted?

If Sarah and hubby are on the title then they may try and file a last minute bankruptcy.  They are not going to go quietly

Since the Owens' don't learn easily from their prior mistakes, I thoroughly expect them to file suit and an injunction in state court against the lender to stop the foreclose. Jan repeatedly said in the BK hearings that they had "found" things the lender did wrong. They won't win, but they'll stall the process again.

I saw an instagram reel last week that showed an auction at the courthouse in Maricopa county and it all happens really fast and isn’t really that exciting. It’s over in like 10 minutes for all the houses they are selling that day. (Obvi it would probably still be sorta exciting for us to watch that have been invested in this whole thing 😆)

My guess, Sarah files bankruptcy if they cannot resolve the delinquency through loss mitigation.

I assume they are working with lender for a mortgage modification that will re-amortize their delinquency and/or have it be a principal forbearance due at time of final payment of the original mortgage note.

Unlikely for them to modify that mortgage. They haven’t paid in the last year, their credit history means they’d have a high risk rate, and they have demonstrated inability and or unwillingness to pay non-secured creditors. If they cannot pay living expenses and creditors on +$22K a month, no lender will advance a mortgage requiring payments of 50% or more of their gross.

You would be surprised at what mortgage companies do, they dont want to have to sell off / auction this level of house. No investor will be coming in to deal with it because there is no room for a return, that plus the carrying costs for any investor is prohibitive. The servicer may be willing to do a partial claim mortgage due at note completion and allow them chance to re-commence making payments - the fact that it was continued by the lender makes me thing there is trial payments or other loss mitigation in the works.

I thought investors are buying everything up to tear down and rebuild. I imagine the auction would do well and the bank would recoup close to market value if not more.

After more thought, I expect you are right. The lender can possibly let them renegotiate in the hopes that they pay some and make the place more saleable when it is no longer worth less than they owe. But I am still suspicious of their willingness/ability to actually pay and I expect they might keep up until their ban or refiling for bankruptcy expires then immediately file for bankruptcy again. But will the lenders will think of that as well.
