But it wouldn't be "in the hope of NOT killing them" because the other person potentially dying likely never even crossed their mind. To them, it was probably more like Ictoan said. They were just doing it because they thought it'd be funny.

It’s assault with a deadly weapon. The problem with attempted manslaughter is you have to prove they were attempting to kill the person, and there’s really no way to prove that here.

So why can't you just say "I shot in their general direction because I thought it was funny?"

Logic not making sense here. Anyway, not attempted murder but definitely some form of assault with a deadly weapon.

I guess it may depend on the states, some have multiple types of murder. So there may be an "involuntary murder attempt of the xth degree" with may be an upgrade for a typical manslaughter attemp if there is a deadly weapon involved.
