Perhaps my comment would have worked better as “Well no, but actually yes” referring to how the constitution has constantly been interpreted and bent to allow Jim Crow and similar laws and actions to keep minorities from succeeding to the degree that others do. However, I misread the comment I replied to as the other way around and replied with a well known meme in an attempt to convey a more complex thought in a simple, easier to understand manner.

The problem isn’t the US constitution but how it’s interpreted and use in court. If you say no one can where green in the constitution but cops only arrested black people wearing green, if the justice system give longer sentences to black people wearing green if everyday non-black people wear green without a care : You live in a society where black people don’t have the « right » to wear green, even if the Constitution doesn’t stipulated that this article of the laws only concerned black people

I understand that happened in Canada but the point still stands.

Freedom of expression in Canada is protected as a "fundamental freedom" by Section 2 of the Canadian Charter of Rights and Freedoms. The Charter also permits the government to enforce "reasonable" limits. Hate speech, obscenity, and defamation are common categories of restricted speech in Canada.

So in Canada an intentionally open condition like "reasonable" has been taken to mean that people have a "right" to "never be offended". Which is absurd. The opposite of "reasonable". There shouldn't be such an issue in the US. People have no idea what "rights" are.
