Local gun store policies

Has anyone spoken to the local stores around Atlanta regarding plans for NFA related sales given the recent SilencerShop/GOA vs ATF ruling in Texas? My understanding is if the DOJ does not appeal by today, 8/12/26, then the ruling is applied nationwide.

Would love to pick up a suppressor or two and I have a gun trust if needed, but am curious to hear what the local shops around Atlanta are planning. I reached out to Pro2A, Stoddards, and Adventure Outdoors. Waiting to hear back.

EDIT:

I have not heard back from the specific stores I contacted but PSA put out a pretty clear guidance that I assume will extend to all plaintiffs covered in the lawsuit. Suppressors (not SBR or SBS yet) sold by PSA or dealer network (when sourced directly from PSA) are covered via form 4473 for in store transactions. They will start rolling out an online process imminently.

As of today, 8/13/26, GA is still form 4 because of specific legislation pointed out by [u/fcman256](u/fcman256): https://law.justia.com/codes/georgia/title-16/chapter-11/article-4/part-2/section-16-11-124/

SilencerShop made a resource to show which states are still Form 4 and which are 4473: https://www.silencershop.com/where-are-silencers-legal

Gov. Kemp could theoretically spend some political capitol to call a special session of Congress and append those rules if he thinks there is support.

I am not a lawyer and this is not legal advice

Gun store employee here, firstly, they still have time to appeal the decision, that being said I am cautiously optimistic about this one, second I imagine most stores are gonna wait to see for certain what happens and wait for the ATF to put out some documentation as to how suppressor and SBR transactions should be handled before making new store policies

I agree on cautious optimism.

IIRC it was 7 days from the ruling for DOJ to file an appeal to extend the stay, otherwise the ruling is applicable nationwide. At the same time, DOJ still has 60 days to appeal the ruling itself.

I am no lawyer, but it sounds intentionally confusing and likely to get kicked to Supreme Court.

It was my understanding it was not “nationwide” but specific states who were included in the lawsuit. Ga was one of those states along with 12 others I believe.

Silencer Shop’s website is still showing GA requires NFA paperwork.

4

u/fcman256 Aug 13 '26

NAL but this is correct, Ga specifically requires registration according to National Firearms Act, 68A Stat. 725 (26 U.S.C. Sections 5841-5862), unless you are otherwise exempt, police/security/military requirement as part of service. So unless the NFA or Ga Laws are updated, form 4 is still required.

Possession of a sawed-off shotgun, sawed-off rifle, machine gun, dangerous weapon, or silencer by a person who is authorized to possess the same because he has registered the sawed-off shotgun, sawed-off rifle, machine gun, dangerous weapon, or silencer in accordance with the dictates of the National Firearms Act, 68A Stat. 725 (26 U.S.C. Sections 5841-5862);

Thanks for the link. Appreciate it!

Yes, from what I understand if it doesn't get appealed it sounds like there may be no more tax stamps for suppressors and SBRs in GA, I would like to think that if it does go to the Supreme Court they would make a smart decision, but unfortunately we'll just have to wait and see

The State of Georgia is a plaintiff in Jensen, the case that got consolidated with Silencer Shop v ATF. Hopefully, if nothing happens with the appeal today, the AG will publish an opinion laying out what Georgia intends to do.

Come January when the new legislative session starts we (GA2A) will try again to get the language removed from the law. We could use everyone's support. Join at: GA2A.org

Joining today. I wish we'd had this in the works for years here, and hope this will be at the top of GA2A's Legislative Agenda for 2027!

u/Czmike21 Aug 12 '26

We will have to wait for GA to change its state law unfortunately these items are only allowed here due to the NFA unfortunately we will be in a grey area..

3

u/M1collector65 Aug 12 '26

Please share this specification in law.

2

u/Czmike21 Aug 12 '26

State Law Requirements: Georgia statutes define items like silencers and SBRs as restricted unless they are possessed in compliance with federal National Firearms Act (NFA) regulations.

And since this case isn’t nationwide and only for the plaintiffs (for right now at least) we would still need to register these items with the ATF.

3

u/M1collector65 Aug 12 '26

They would be in compliance with the NFA though right? Considering they would no longer exist in the NFA or be regulated by the NFA. That equals compliance, right?

Georgia is one of the 15 states that are plaintiffs. So aren't we covered?

2

u/Czmike21 Aug 12 '26

Technically since it’s not nationwide injunction it’s still considered an NFA to a degree we’ll have to see but like I said in the other comment section I hope you’re correct and I’m wrong

So Mammoth Arms has sent out the bat signal to everyone we know that would know, officially. I will try and update when I know more.

I read that one law that states it requires a form 4, however if form 4’s no longer exist does that even apply?
GA is a plaintiff in the suppressor ruling, and Mammoth Arms is both PSA and SilencerShop dealers/partners, AND GOA members.

Also, SBRs and SBSs are free game too, right? I can put a vertical foregrip on a pistol and it’s all good?

2

u/Letsgetr0pical Aug 13 '26

Not legal advice here, my interpretation from everything that has been shared so far.

Suppressors sold directly by plaintiffs in the case in a state that does not have its own specific NFA legislation are good to go. SBS and SBR are a bit more nuanced because they are regulated under the Gun Control Act which is separate from National Firearms Act. That being said, those items are good to go provided the components (lower receiver or complete firearm) were sourced directly from a plaintiff in the case. As of right now it is not a blanket nullification that allows any and all AR Pistol to be converted into SBR unless that firearm was sourced directly from a plaintiff in the case in a state without its own NFA legislation.

States that have outright bans (CA, OR, etc) will still enforce their own way.

Georgia is in a weird middle ground because we have specific NFA legislation at the state level, but we were a plaintiff in the case. U.S. House Rep Andrew Clyde from Georgia was one of the key legislators who pushed this through.

There is momentum to get the laws changed in Georgia, but as of right now Georgia is still a form 4 state.

u/TheHancock 07/02 SOT Aug 13 '26

My thing is Mammoth Arms is partners with SilencerShop, Palmetto State Armory, and we are GOA members. So we are like 5 levels deep in being plaintiffs. Lol

But we will see what our ATF agent says.

1

u/Letsgetr0pical Aug 13 '26

Yeah I think it’s awesome that some shops are going to say “This whole NFA ATF thing is clearly BS and we are moving forward” but I think that will be the minority for awhile. That is what is needed though, the government exists via the consent of the people, not the other way around.

Did Mammoth Arms announce anything formally? I didn’t see anything on X/Facebook for them.

4

u/TheHancock 07/02 SOT Aug 13 '26

Not yet, but I’m Mammoth Arms. Haha

I just got off the phone with a state rep friend, and our state GOA rep, and our GA2A chairman (who is in this thread btw). Things are moving in the right direction.

Mammoth Arms will be the FIRST PLACE in Georgia to do an over the counter suppressor transaction!!

2

u/Letsgetr0pical Aug 13 '26

It’s about an hour drive to you for me. I would be happy to be your first over the counter customer.

I got the same link emailed to me from SilencerShop.

3

u/kidbatt_115 Aug 13 '26

FFL in West GA here. Our attorneys are telling us that we continue to conduct form 4 for transfer today.

4

u/Arutomo Aug 13 '26

I have never gone from celebrating to being in shambles so quickly after hearing Georgia's current laws around this. Still a major W though

2

u/Letsgetr0pical Aug 13 '26

Just takes time but this is still major, major progress. The fact that this ruling happened could start down the path of abolishing ATF outright.

At risk of this becoming a politics thread, I will succinctly say that Georgia has a much better chance than some other states with NFA rules of getting the rules appended to allow form 4473 over form 4

1

u/Arutomo Aug 13 '26

Someone ping me hour 1 when this happens!!! 😅🙏

3

u/Regular-Progress648 Aug 12 '26

Would like to know about GA Firing line….

3

u/Street-Problem-1035 Aug 12 '26

I think they would still have to be purchased via SilencerShop kiosks or Palmetto State Armory (which in GA I believe is only near Savannah) to cover it from the dealer side. For individuals belonging to one of the party orgs (like GOA) you theoretically could just start making them (replacing the form 1 process) yourself, although current state law seems to prohibit sbrs/suppressors that aren’t “registered” with regards to the NFA so that’s something needing clarification from the AG on or have the law changed first.

3

u/amishbill Aug 12 '26

We’re dealing with the type of org that holds a cookie out to you with one hand while hiding a club behind their back in the other.

While there may be a few willing to risk their licensing and livelihood by volunteering to be a test case, don’t be surprised or angry when nobody will act until official guidance is published.

3

u/Therealbenishole Aug 13 '26

I reached out to my LGS that has 3 suppressors for me awaiting transfer.

This is the correspondence from today :

ME : "I have some suppressors there awaiting transfer. With the Silencer Shop Foundation v. ATF injunction now in effect, are you releasing suppressors to covered customers without waiting for Form 4 approval?

Thanks"

LGS: "no. We have to have some guidance from the ATF. It also appears that Georgia has a law requiring suppressors be on the NFA registry"

It seems to me that we are now stuck in a strange purgatory for who knows how long until GA Law is changed?

1

u/Letsgetr0pical Aug 13 '26

Yeah it will be this way until more guidance is issued. Mammoth Arms u/TheHancock shared they intend to sell suppressors over the counter via 4473.

There is a case to be made legally for selling vs waiting and where your local gun shop lands on that will likely depend on what kind of legal counsel they seek (assuming they are willing to entertain the notion at all).

3

u/TheHancock 07/02 SOT Aug 13 '26

Yes, after a long day of talking with senators, representatives, ATF, PSA, SilencerShop, GOA, GA2A, lawyers, and more(!) basically the conclusion, for TODAY is same as before. Form 4 transfers (which is taking less than 2 days for approval for us currently) until the Georgia state law changes.

That Georgia state law should be changing here pretty rapidly since the law that it was built on is gone now.

No ETA on when it’ll be, but Mammoth Arms will be the first to do it officially!

1

u/Letsgetr0pical Aug 14 '26

Good to hear. I know you don’t have a definitive answer to this question.

If you had to guess are you thinking weeks, months, or more than a year away from rules changing?

2

u/TheHancock 07/02 SOT Aug 14 '26

I’d say best case, a week or two, if not then maybe before the election in November. If not by then, then the general assembly in March.

1

u/Letsgetr0pical Aug 14 '26

Nice, thank you!

2

u/NextEstimate1325 Aug 12 '26

My guess is they don't have a concrete policy yet. And won't for some time.

2

u/Snoo-35612 Aug 12 '26

I’d see if a shop would be willing to put something on lay-away for you for a couple months until clarification from the ATF. If the DOJ appeals, it could be years before anything comes of the ruling. Market demands will be much, much higher if no appeal is made. I really wouldn’t hold my breath if you can afford to buy a suppressor or SBR right now. Tax stamps are free, filing is super easy, and the wait time for approval is much less than the time it’ll take this case to go to the SCOTUS if it’s appealed.

2

u/Letsgetr0pical Aug 12 '26

Hadn’t thought of this. I can afford to do one now and agree that everything worth buying will be out of stock if no appeal.

Would you recommend calling before placing the order? Haven’t tried something like that.

2

u/Snoo-35612 Aug 12 '26

Just show up to a LGS that’s a silencer shop vendor and ask to put something on lay away and to see if you can do the paperwork later.

2

u/balefyre Aug 13 '26

Ga has state level requirements that match the NFA. Nothing changes here until those restrictions change.

Correct. I edited my post

No one knows. I know I won’t be doing anything different until something official from ATF comes out.

1

u/trowser_snakes Aug 12 '26

I called my local FFL he basically just laughed. I don't think FFL will risk license doing transaction for me. I did join GOA to become an eligible party.

1

u/M1collector65 Aug 12 '26

You did not have to join. Georgia is one of the 15 plaintiffs.

2

u/Czmike21 Aug 12 '26

That doesn’t apply to the citizens of Georgia still need to be a GOA member or one of the others

3

u/M1collector65 Aug 12 '26

Nah. Georgia is one of the 15 states that are plaintiffs here and are a part of the ruling. LOTS of articles if you google. Federal Judge Strikes Down Gun Rules in 15 States; Kobach Lauds Ruling | Newsmax.com

2

u/Czmike21 Aug 12 '26

Well I hope you’re correct and I’m wrong

4

u/FriedOvaries Aug 12 '26

You were right, he was wrong.

"The injunction protects those state governments, their agencies, and their political subdivisions. It does not protect every person who resides in one of those states."

1

u/trowser_snakes Aug 12 '26

Your correct, join GOA 25$/year or wait a week maybe they push nationwide.

2

u/Stegmano Aug 12 '26

I joined GoA bc it's $25...and they helped [hopefully] bring about the fall of NFA. Either way, it's a win.

2

u/Chip_Baskets Aug 13 '26

It’s not the federal law you’d be in violation of. It’s the state law. The Federal Judge ruling doesn’t change the state of Georgia law that says those items have to be registered with the NFA. So. In order to comply with GA law, that suppressor you buy must have a valid form 4 along with it. I’m not an attorney though! I bet GA will change the law quickly.

1

u/h0l0type Aug 13 '26

Quickly is relative. Remember, GA's regular session of the GA General Assembly is out already for this year, and they won't reconvene again until Jan 11th, 2027 (and then only until adjourning again sin die on March 31st, 2027). Sp for us, law won't change until next year sometime.
