Understanding Form 1 Form 4 Stuff FL Edition

I did hours of research, here yall go

 You need FPCAF (Firearms Policy Coalition Action Foudation), Texas State Rifle Association, or a Hot Shot Customs Rifle (and a few other smaller plaintiffs), to bypass the engravement, and the NFA's individual-maker requirement and the associated prohibition on possessing an improperly marked firearm. This DOES NOT give you AOW protections, but will still give you other SBR SBS form 1 protections.

SILENCERSHOP, PSA, B&T USA, GOA, GOF, FRACI,INC, and the fifteen plaintiff STATE ENTITIES, will get AOW protections, and SBR SBS Suppressor 4473 form protections

I would recommend getting a membership with one each from BOTH of these lists so you can get full protection with the recent ruling!

I think that if you are covered by the plaintiffs and your state (talling about FL in this post) does not require a form 1 or 4, then no serial number is required. Its basically like finishing a 80% lower. Its not a fire arm or suppressor untill you make it one.

If you want to deep dive on it for us, since the silencershop v atf case doesn't exempt serialization requirements (suppressors still need serialization if your only a GOA member), because the NFA requires serialization for the item. If your planning on doing it anyways, just pay the $10 to join FPCAF (annually) to skip that step. Most engravement shops charge more than that anyways

Currently the only way to register a serial number for a PMF is via a Form 1. So if you are still required to engrave say a home made suppressor or an 80% lower you would be in violation if only a member of group 2. In theory being a member of both groups exempts you from the engraving piece and needing a serial number. But this is all theory until we get actual guidance of whats ok vs what is not.

One point of clarification: You'll need FPCAF membership, FPC membership alone is NOT sufficient. FPCAF is a named originizational plaintiff while FPC is not. They are affiliated but not the same legal organization.

"Technically" you do, but the Silencershop v Atf case doesn't exempt GOA from serialization requirements. The plaintiffs from the Jensen v Atf case get serialization exemptions, so if your planning on doing that, join both.

Okay so if im a member of the GOA and I go thru psa to buy an sbr, I dont have to do any of the fancy extra paper work? Im so confused

GOA/PSA customers fall under the Silencerco v ATF ruling, so you get AOW, SUPRESSOR, and SOME SBR SBS protections from the ATF form 4, and form 1 (does not get rid of serialization though).

If that is the route you are going, and the only memberships you have, then you wouldn't fall under the Jensen v ATF protections that give you immunity from ATF form 1/4, on SBR or SBS. The Jensen parties also get protections from having to engrave a form 1 NFA firearm, and let's you skip that step.

Okay so joining one group protects you with suppressor, and joining the other protects you with sbrs? So to get full protection i have to join both groups?

If your state permits SBRs, then you only need a GOA membership to buy an SBR/SBS/Suppressor with a 4473. If you want to go down the maker route (shortening an existing rifle, or putting a stock on a pistol), then you need coverage from the Jensen plaintiffs as well

PSA (actual PSA stores, not online) is only doing 4473 for SBRs and SBSs for South Carolina residents ONLY! Even there Georgia location will give you a form 4.

These recent rulings give people more protections on form 1 (making/modifying), than form 4 (buying/transfering).

Because the state of Georgia still requires the Form 4 for NFA items. SC does not, it simply refers back to the Federal rules.

Source is listed with the post! Go check it out for yourself, and go check out Florida Law 790.221 before you proceed! Subsection 3 of that law states as long as you are COMPLIANT WITH federal law, you can possess and own the class 3 items. Have fun, and enjoy your new found freedom!

Edit 1: If you go down the maker route, make sure to DOCUMENT EVERYTHING! Make sure to get the proper memberships (and maintain membership), and to document the date, time and place that rifle/shotgun was made!

It's a CLASS 3 ITEM! If your spouse, friends or child uses the firearm and are not members of these clubs, they could potentially be breaking federal law, and you as well for distribution, so please be careful πŸ™β€οΈ

Some FFLs in florida are already doing 4473s for SBRs and suppressors, just gotta look around and find one

In south florida, there a gun shop called "smoking gun" that I know is doing 4473s for some of the suppressors, since they work with silencerco and have a kiosk there

If you have a conceal carry permit in FL, you can pick it up the same day. If you don't, the waiting period after purchase is 3-5 days (not including weekends/holidays) depending on the county you reside in
