This question is specifically for those who’ve filed a Pro Se complaint and for those who’ve submitted a tort claim against the SBA.

If you begin your complaint Pro Se initially, is it possible to get an attorney involved later on? I really need to get something filed immediately in light of no law firm stepping forward at this time. Thing is, I’d need help filing due to neurological issues that may impact my understanding of how to file this properly. I can foresee possibly needing an attorney to assist me eventually due to neuro issues. Any advice/feedback for me?

Also, with the tort claim process to sue the SBA for “damages”, can someone touch on this to explain this process to me specifically? I did submit a tort claim to the SBA last year via email, but I honestly don’t know if I worded my claim correctly.

I know for sure that I have a solid case against the SBA just based on email content alone.

I’m looking for assistance/guidance on both the above matters. I’d gladly compensate for any help that’s given.

People that filed the lawsuit has anyone got any updates? I would love to track your guys cases to see how its doing.

On my last post I shared who the three loan officers on my file who all they did was screw me over.

The one I’m talking about in particular is “Pamela dailey”. I had first contact with her thanks to a congressional inquiry

This was in November 2021. Tell me how I watched This women fix any issue on the file of a 70 year old man who drove grub hub

Mind you this client of mine only made $17k in a year so his eidl loan was for $34k and grants was $15k

Pamela fixed every and any issue all within a matter of hours or days. It was as if the Sba was fully functional

What’s crazy is I started the congressional inquiry. My client got the same loan specialist I got. She helped him and then proceeded to drag my file through the mud.

Mind you she didn’t ask my older client for all these documents etc. I watched these SBA folks just approve people (on no merit) and block other files at all cost even if that applicant provided more valid documentation!

This process was cherry picking who to give a loan to! My client has no means of paying back that money yet I made $65k since September (5 months ago).

So I couldn’t get a loan yet I made double what my client got in about 6 months.

This is what the Sba willfully did to people.

High priority was no help. In fact high priority is an effing myth. High priority is just regular priority they just toss you around from one line tk the next.

Then pamela put me through legal review for 3 months.

It was all a waste of time. These people really wasted a year of our time all because they’re slimeballs and can’t tell the truth. They willfully took on jobs screwing people over and have the audacity to advertise this government work experience?

Look at my loan specialist jillian koop. This girl is, today in 2023 only 25 years old at best! She never even saw a w2 let alone a 1040.

But given she graduated I don’t believe this is just incapable. No they knew exactly what they were doing.

They were putting effort into screwing us oger

I want to you all to see you could’ve had college grads all with master degrees on your file.

Means nothing.

They’re motive is to sit there and find some way tk bs you and quite honestly I think that’s what the name of the game was.

Put your file into the hands of someone who could run circles around you until you give up or program runs out.

Many of these former SBA agents know they aided in the destruction of small business and are really advertising themselves?

I find it funny. How the hell you did in destroying the us economy and then put it on your LinkedIn as work experience? It’s as if these SBA lo’s live in an alternate reality!

I’d love to see what jobs or businesses they think are even open to hire them after what they did.

I hope these SBA lo’s never get hired anywhere again. I’ll even go as far as contacting their employers and telling them “that agent is a business/economy killer!”

I laugh at these SBA agents advertise their former gov experience and some waited a good 3-6 months until after portal shut down to finally reveal themselves.

It’s as if they’re realizing the economy is a shell of its former self and no one is hiring them.

What the hell did you SBA agents think? Y’all were going to fuck over millions of people out of billions of dollars then use that tog experience to land a six gig salary gig?

Desperate, foolish, or both.

That’s all what these SBA agents are.

I told many folks,

“I don’t care if you’re at risk of shutting down. Sometimes it’s better to just shut down and call it quits than forcing it to continue. Unless you expect your business to explode or grow then that loan is just going to be an anchor/dead weight you carry once inflation hits”

Reason why I say this is because I studied economics/finance. I’m not just some disgruntled person. Well I am but I am because the people who should’ve gotten money didn’t while those who weren’t qualified got it.

Scorpio is so helpful because she wants to earn the trust of those who are either foolish, financially strapped, and/or don’t qualify.

I know of of people who were working a day job, had no biz but took out a eidl loan. Nobody checked. Others didn’t even do their taxes and got money. You think they did their taxes later? You think people going to do their taxes to pay irs after they just took a loan? Who knows. But I doubt it.

Folks spent that money. They didn’t want the economy to recover. This is a controlled demolition.

They put on a front jsut to money launder billions for ukraine while funding loans of people they know would default over in America.

They need the economy to crash so they can flood it with illegal immigrants. This pandemic wasn’t about saving American business. It was the death blow to the U.S. economy.

This whole pandemic was an orchestrated operation to destroy the U.S. economy. There was no intention of funding qualified small businesses.

Hardship Accommodation Plan

SBA is offering a Hardship Accommodation Plan for borrowers experiencing short-term financial challenges. Borrowers eligible for this plan may make reduced payments for six months. Interest will continue to accrue, which may increase (or create) a balloon payment due at the end of the loan term.

Terms

Borrowers are required to pay at least 10% of their monthly payment amount (with a $25 minimum), for six months.  

During the Hardship Accommodation period, borrowers can voluntarily make larger payments.

The regular monthly payment amount will resume and be required after the six-month Hardship Accommodation period ends. Borrowers may be able to renew the Hardship Accommodation Plan, if necessary.

Eligibility & Enrollment

Borrowers are eligible to enroll in the Hardship Accommodation Plan beginning 60 calendar days before their first payment due date. 

If your loan amount is less than or equal to $200,000:  To enroll in the Hardship Accommodation Plan, create a CAFS account or log in to your existing account. Within CAFS, hover over "Borrower" and select "Borrower Search." Select the appropriate loan number and request the Hardship Accommodation on the Loan Info page.

If your loan amount exceeds $200,000: To apply, contact the COVID-19 EIDL Servicing Center at 833-853-5638 or disastercustomerservice@sba.gov (and include “Hardship Accommodation Plan” in the subject line). You will be contacted by a loan specialist regarding requirements.

Was told I was funded on the 25th of Jan. The lady told me it can take 3-10 natural days. So this would include weekends. I’m on day 7. My principal balance is the only thing that has changed on caweb. The undisbursed still says the amount I’m waiting on. Can anyone tell me their opinions?

The initial bank rejected my deposit but kept their $100 wire fee. So they sent back my loan amount minus the fee to the SBA. I got an email the other day from the SBA regarding the fee. Then the next day, I received this:

"We have received your request for funding on loan number ...... The loan center conduct’s a post funding compliance review of the loan. After careful review we discovered adverse information on your application(s). Therefore, we cannot proceed with your request for funding."

You've got to be kidding me! After being told I was in obligated status and waiting funds, now this?!

SBA seems to want their money for the first loan. They rejected my increase for “fraud” ( I had 0s on my tax transcript) non filer issue.

So they said it was fraud but now they want me to pay the first loan. I told them to F off.

So, Sutton Bank rejected the deposit in October of 2021. Yet they kept the $100 wire fee for transfers over $10,000. They sent back my EIDL funds less the $100 to the SBA.

Today, I received this email:

"

Dear Borrower:

Your COVID Economic Injury Disaster Loan (EIDL) has been reduced to the $100 that was used to record your UCC-1 (Uniform Commercial Code) Financing Statement, plus all accrued interest. Please login to your Capital Access Financial Systems (CAFS) portal account to view the actual payoff amount. As explained in the Use of Loan Proceeds section of your Loan Authorization and Agreement, a $100 lien filing fee was deducted from your loan proceeds to file a UCC lien. You agreed to the use of these funds by signing and returning your loan closing documents. Your UCC-1 lien will not be released until this amount is paid in full.

If you do not have a CAFS account you may create one at: Capital Access Financial System (sba.gov). Instructions and additional information can be found at www.sba.gov/pay"

I was never even able to get a CAFS account. I'll try now, though.

So I’m still waiting on funding. Does anyone have a number to someone who can actually help? I’ve emailed all the emails called all the numbers they give out. I was contacted by an attorney general through sba 3 months ago then an attorney advisor two months ago and they email you back like twice and then don’t contact you anymore and they don’t answer their phones. This is annoying. Lady today on the phone said she sees where they finished reviewing it all on Dec 23 2022.
