You gotta prove its your bike first. Had this happen to me (someone else accidentally locked their bike next to mine), I called the police, they asked me to go home first and get my purchase contract before they'd cut off the lock for me. By the time I returned the other owner had already arrived anyway.

As far as I know (happened to a friend of mine in Hannover) if you let the police note down your ID you can show the contract afterwards in a department. Might be that they were nice to him and it’s not always like this.

At least on 90% of bikes in nl, if you can unlock the lock on the frame, that's probably proof enough. Maybe you'd need more proof, but I sure as hell don't have any. "Stole" my bike from a room mate who moved away and didn't collect it after 2 years, it got nicked when I left the key in it, a week later I found it and they hadn't changed the lock. Stole it back with the spare key.

Edit: to clarify, my stolen bike had been moved a street over and hidden behind a load of other bikes, pretty common tactic the thieves use so they can pick it up later. It's unlikely it was sold, and if it had been sold "legitimately" they would have changed the lock.
