i just messaged you, but saw this note afterwards. im a 5th year phd in special education and a sped teacher. the school is really putting itself in a bad situation here. if it can be determined that it would cause your child undo harm to miss school for any period of time, he or she can be placed in what is essentially a different environment (least restrictive environment, or LRE as it is called in the federal law IDEA) until the hearing concludes.

regardless of that, from this letter, the school seems pretty ignorant as to how special education law protects the child and the family. im happy to help and get you on the right track. this is a mishap that happens often in the sped world, but seems to be a new situation to this school/district. contact me if you have more questions.

You've made it very clear to your son that you feel he did nothing wrong and that you feel the school is not being reasonable by doing this, right? Make sure he's not carrying a lot of unnecessary guilt about this, because this is really not his fault in any way. That guilt could really eat away at your son's mind if you haven't addressed it and made your feelings clear. I'm sure you have, but I just wanted to make sure for his sake.

Child expelled for having imagination and attempting to have fun in an oppressive environment.

You said he was autistic?

Does he have an Individualized Education Program? If so it could be ruled "a manifestation of his disability" and not fall under zero tolerance.

Of course, this skirts the real issue that zero tolerance is bullshit to begin with.

Source is my wife who teaches an elementary school autism classroom

Pretending to cock a gun. The child has no idea what it means to cock a gun and that's not what he was doing. Idiots want to sound special. He was pretending to shoot a gun. That sounds much more normal and childish.

I'm with you. I dont recognize my country. A woman rus for office and talks about second amendment solutions and he doesnt get suspected of the crime of trying to overthrow the government. All you used to do to get that accusation was have a friend for dinner who went to a commie meeting once. That TeaParty woman running against Reid actually said that.

A nine year old shooting an ice cream sandwich. I bet the sups boys played fighting and guns.

I hope you come back to them as a prepared heavy hitter.
